According to article 351 of the Criminal Law, illegal cultivation of opium poppy, marijuana and other narcotic plants shall be forcibly eradicated. In any of the following circumstances, a person shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or surveillance, and a fine:
(1) Cultivation of more than 500 opium poppy plants or less than 3,000 plants, or a relatively large number of other narcotic plants;
(2) Planting after being handled by the public security organs;
(3) Resisting eradication.
According to Article 71 of the Law on Administrative Punishments for Public Security, whoever commits any of the following acts shall be detained for not less than 10 days but not more than 15 days, and may also be fined not more than 3,000 yuan; where the circumstances are minor, they shall be detained for not more than five days or fined not more than 500 yuan:
(1) Illegally cultivating less than 500 opium poppy plants or other small amounts of narcotic plants;
(2) Illegally trading, transporting, carrying, or possessing small amounts of seeds or seedlings of uninactivated opium poppy or other narcotic plants;
(3) Illegally transporting, trading, storing or using small amounts of opium poppy husks.
Whoever commits the conduct in item 1 of the preceding paragraph and eradicates it on its own before maturity shall not be punished.
