Sentenced in March for moral and sexual harassment, a former employee and union delegate from Europe 1 saw his dismissal canceled by the courts in June 2019, pushing the management of the radio to reinstate him.

This former head of the antenna's games, CFTC member of the CHSCT (health, safety and working conditions committee) and secretary of the works council, Kamel A., had been sentenced to 10 months in prison with stay by the Paris Criminal Court for moral harassment against three colleagues and sexual harassment on a fourth.

This judgment, which he appealed, followed complaints filed two years earlier.

An "irregularity" in the dismissal procedure

In December 2018, the management of Europe 1 submitted a disciplinary dismissal request to the labor inspectorate, a procedure provided for protected employees such as Kamel A., delegated by their union mandates.

Faced with the rejection formulated by the body two months later, in particular for a technical defect, she turned to the Minister of Labor at the time, Muriel Pénicaud, who had authorized the dismissal in June 2019.

But the Paris administrative court decided to overturn the minister's decision, pointing to an "irregularity" in the company's procedure, according to its judgment of December 1.

It is for this reason that the request for reinstatement formulated last Friday had to be accepted by the management of Europe 1, which appealed.

In a response addressed to Emilie Mazoyer and to all the employees of Europe 1, the president of the news center of Lagardère, on which the radio depends, Constance Benqué, promised "total and unfailing support to all the women victims of actions ”by Kamel.
