During the second-instance trial, the court organized the prosecution and defense to conduct court investigation and court debate on the focus of the dispute around the reasons for appeal put forward by the appellant Wu Xieyu and the defense opinions put forward by the defender. On August 2021, 8, the Fuzhou Intermediate People's Court of Fujian Province publicly pronounced a verdict in the first instance of the defendant Wu Xieyu in the case of intentional homicide, fraud, and buying and selling identity documents in accordance with the law, and decided to carry out the death penalty, deprive him of political rights for life, and fine him 26,<> yuan on the grounds that defendant Wu Xieyu committed the crimes of intentional homicide, fraud, and buying and selling identity documents.

The court of first instance found that the defendant Wu Xieyu was pessimistic and world-wearing, had thoughts of suicide, and after his father died of illness, he believed that his mother Xie Moumou's life had lost its meaning, and in the first half of 2015, he had the idea of killing Xie Moumou, and purchased crime tools online. At about 2015 o'clock on July 7, 10, Wu Xieyu took advantage of Xie Moumou's home to change his shoes, holding a dumbbell bar and continuously hitting Xie Moumou's head and face, causing Xie Moumou's death. Later, Wu Xieyu concealed the truth from relatives and friends that Xie Moumou had been killed by him, fictitiously accompanied Xie Moumou to accompany him to study abroad, and defrauded relatives and friends of 17.144 million yuan on the grounds that they needed living expenses, tuition fees, financial resources and other reasons to squander it. In order to evade detection, Wu Xieyu purchased more than 10 identity documents to conceal his identity.

The court of first instance held that the defendant Wu Xieyu intentionally and unlawfully deprived others of their lives, and his acts constituted the crime of intentional homicide; For the purpose of illegal possession, concealing the truth, fabricating facts, and defrauding others of money, the amount is particularly large, and his behavior has constituted the crime of fraud; In order to evade criminal punishment, the act of purchasing identity documents constitutes the crime of buying and selling identity documents and shall be punished concurrently according to law. According to the facts, nature, circumstances and degree of harm to society of the crime, Wu Xieyu was convicted of intentional homicide, fraud, and buying and selling identity documents, and sentenced to death, deprived of political rights for life, and fined 103,000 yuan.

After the first-instance verdict was pronounced, Wu Xieyu was not satisfied and filed an appeal. On March 2022, 3, the Fujian High Court held that the case was ruled to "suspend the trial" due to "irresistible reasons" during the second-instance trial. (End)
