The National Assembly voted on Friday, November 23 that police officers who receive complaints and handrails remain anonymous. Only their administrative registration number, quality and service will be mentioned on the minutes.

The National Assembly voted on Friday the anonymization of police and gendarmes receiving complaints and handrails, of which only the number of registration number will appear on the PV, against the opinion of the government, during the examination in first reading of the project justice reform.

Currently, the Code of Criminal Procedure gives the possibility to national police officers and gendarmes not to be identified by name in certain cases, notably during an investigation into a crime or an offense punishable by at least three years of imprisonment.

The deputies have broadened this Friday this anonymization "to any filing of complaint or handrail" . The officer will be identified on the minutes by means of his administrative registration number, his quality and his service or unit of assignment.

"The goal is to protect police officers in the performance of their duties," said Nathalie Elimas (MoDem), at the initiative of her colleague Isabelle Florennes of the adopted amendment.

He has received the support of the leader of the National Rally (ex-FN) Marine Le Pen, Insoumis Ugo Bernalicis and Jean-Michel Fauvergue (LREM), former boss of the Raid (2013-2017).

But the custody of Sceaux Nicole Belloubet and the rapporteur Didier Paris (LREM) opposed, after having issued a favorable opinion on a previous amendment of Aurore Bergé (LREM) that did not go that far. Adopted by the deputies, it reinforces the anonymity of judicial police officers in "situations where the revelation of their identity would endanger their lives (...) or those of their relatives" .

"For the handrails, it is a provision that seems to us quite excessive," said the rapporteur. Ms. Belloubet said she felt that a "balance" had already been "found" on this topic, through the 2017 law on internal security.

"We do not understand your reluctance to be able to completely avoid the thugs and that the offenders can directly attack the police (...) in their private sphere," said Ms. Le Pen.

It is necessary "to evolve on this aspect , " said Mr. Bernalicis, recalling the double murder of a police officer and his girlfriend at their home in Magnanville (Yvelines) by a jihadist in 2016.
