Mohammed bin Rashid issues a decree abolishing a special judicial committee

His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, in his capacity as Ruler of Dubai, issued Decree No. (15) of 2021 regarding the abolition of the Special Judicial Committee concerned with adjudicating disputes related to Amlak Finance Company (PJSC) and a company. Financing (PJSC), which was formed by Decree No. (61) for the year 2009.

The decree stipulated that the cases and requests pending on the date of the implementation of this decree shall be referred before the aforementioned Special Judicial Committee, in which no final judgment has been issued, to the competent court of first instance in the Dubai courts, in order to consider and decide on them in accordance with the legally established principles and without charging any new fees.

According to the new Decree, Decree No. (61) of 2009, and any text in any other legislation, to the extent that it contradicts the provisions of Decree No. (15) of 2021, which comes into force from the date of its issuance and is published in the Official Gazette, is repealed.

It should be noted that His Highness the Ruler of Dubai issued Decree No. (61) for the year 2009 to form the Special Judicial Committee to handle the consideration and adjudication of all disputes and cases filed against Amlak Finance Company (PJSC) and Financing (PJSC), and the decree. No. (27) for the year 2011 according to which the jurisdiction of the Special Judicial Committee was limited to disputes related to Amlak Finance Company (PJSC), according to which it was decided to transfer the jurisdiction to settle disputes related to a financing company (PJSC) to Dubai Courts.

• Refer the cases and requests pending before the committee to the competent court of first instance in Dubai courts.
