The Ministry of Justice of Russia has published on the specialized portal regulation.gov.ru a draft of the new Code of Administrative Offenses (CAO). The document, which will be at the stage of public discussion until February 19, establishes new penalties for motorists for traffic violations.

So, according to the project, drivers of vehicles can expect an increase in fines for speeding. The punishment for exceeding 20-40 km / h will increase six-fold - from 500 to 3000 rubles, for 40-60 km / h - from 1000-1500 to 4000 rubles, for 60 km / h and more - a sanction of 5000 rubles or deprivation rights for 4-6 months.

Moreover, a repeated excess of the speed limit of 40-60 km / h or more threatens with a punishment of 10 thousand rubles or deprivation of rights for a year. Currently, a fine of 5 thousand rubles has been established for fixing violations by cameras or deprivation of rights for a year.

For driving without a motor third-party liability insurance policy (CTP), the fine will increase from 800 to 1000 rubles, and for driving a car during a period of use not specified in the policy or in violation of the conditions, the penalty will be 800 rubles, and not 500 rubles, as it is now.

For tinting, the fine will increase from 500 to 1000 rubles, the sanction for repeated violation - 3000 rubles.

The fine for transporting children without car seats will increase by 2 thousand rubles (from 3 thousand to 5 thousand rubles), for officials - by 5 thousand rubles (from 25 thousand to 30 thousand rubles), for legal entities - by 50 thousand rubles (from 100 thousand to 150 thousand rubles).

At the same time, a separate punishment is introduced for individual entrepreneurs - a fine of 35 thousand rubles.

Another innovation will be a fine of 5 thousand rubles for dangerous driving. This term appeared in the rules of the road in 2016, but the sanction was not fixed in the Code of Administrative Offenses.

In addition, a new corpus delicti is introduced: driving the vehicle in a state of intoxication and refusing to have a medical examination if a child under 16 is in the cabin. The sanction for these violations is a fine of 50 thousand rubles and deprivation of rights for a period of 2 to 3 years. At present, a fine of 30 thousand rubles and deprivation of rights for 1.5-2 years have been established, regardless of the presence of a child in the car.

Along with this, sanctions for refusing medical examination will increase - from 30 thousand rubles and deprivation of VU for 1.5-2 years to 40 thousand rubles and deprivation of VU for a period of 2 to 3 years.

Drivers also expect a fivefold increase in fines (from 1 thousand to 5 thousand rubles) or deprivation of rights for 3-6 months for improper behavior on railway tracks, in particular, stopping at the crossing and driving with a prohibiting traffic signal. Repeated violation threatens with the deprivation of a driver’s license for a period of up to one year, while fixing the camera - a fine of 10 thousand rubles.

For “failure to comply with the repeated legal requirement of the police officer to stop the vehicle and attempt to escape, which posed a threat to the life or health of citizens”, the offender will not face a fine of 500-800 rubles, as now, but a deprivation of rights for a term of two to three years or a fine of 40 thousand rubles.

In addition, there will be a penalty for re-driving without a license. The driver will face a fine of 20 to 30 thousand rubles or 40-60 hours of compulsory work.

Also, innovations will affect systematic violators of traffic rules (camera fixation will not be taken into account). Now motorists for three or more such violations as speeding at 60 km / h, driving into a red light, going into an oncoming lane, reversing or reversing in a prohibited place and others, expects deprivation of rights for a period of one to one and a half years or a fine of 30 thousand rubles.

“Haste in accepting a document is unacceptable”

The published draft Code of Administrative Offenses was sharply criticized by Secretary of the General Council of United Russia Andrei Turchak. He said that the faction will not support the adoption of the document in this form, since it contradicts the recent message from the president to the Federal Assembly.

“The message was dedicated to protecting the rights and interests of citizens, caring for people. And in the new draft of the Code of Administrative Offenses, we see mainly the tightening of repressive mechanisms. This is an increase in fines, and confiscation of movable property in favor of the state, and new restrictions on traveling abroad, the introduction of almost "home arrest" for adolescents. The law is needed to prevent crime, and not to create a repressive machine or additional penalties from the population, ”the party’s press service quoted his statement as saying.

Turchak added that the main provisions of the document before adoption "must be discussed with people and finalized according to the results."

State Duma deputy Vyacheslav Lysakov, the author of a number of “automobile” bills, also called for revision of the document in an interview with RT.

“This is only a preliminary text, but now there is information that the work is being conducted in an unacceptable format. In my opinion, there are contradictions in the text, competition with norms, there are inconsistencies. It is completely wrong to introduce a document in this form to the State Duma. Haste is unacceptable here, ”he said.

Against the background of a wide, but mostly negative resonance, the Ministry of Justice on Friday separately explained that the initiative of a significant increase in fines belongs to the Ministry of Internal Affairs. The department noted that these proposals had already been submitted to the government, but their adoption was suspended in connection with the preparation of a new Code of Administrative Offenses.

The Justice Ministry also reminded that a wide circle of representatives of both federal government bodies and the scientific and business communities participated in the preparation of the draft new Code of Administrative Offenses and related bills.

Meanwhile, the press center of the Ministry of Internal Affairs of Russia reported that all comments regarding the increase in fines for traffic rules will be taken into account.

“The comments and suggestions received during the public discussion of the draft new code will be carefully studied, summarized and used to finalize it,” TASS quoted the text of the statement by the Ministry of Internal Affairs.
