A man in his 40s, who was handed over to trial for inhaling Bond while wearing only underwear on the street, was sentenced to the same sentence as the first trial at the appeals court.

Today (27th), Incheon District Court's Criminal Division 1-3 (Presiding Judge Su-min Lee) sentenced A (48), who was charged with violating the Chemicals Control Act (inhalation of hallucinogens), to one year in prison, the same as the original trial.

On July 27 last year, at around 6 pm, Mr. A was handed over to trial for inhaling Bond while walking down the street wearing only underwear.

It was found that he inhaled the hallucinogen by squeezing Bond, a hallucinogenic substance containing toluene into a plastic bag, and repeatedly inhaling it on a street in Namdong-gu, Incheon.

At the trial, Mr. A claimed, "I was walking down the street in my underwear because I wasn't feeling well, so I accidentally found a plastic bag containing bonds, picked it up, smelled it, and checked it." But the first trial judge did not accept it.

In response, Mr. A appealed on the ground that "the sentence of the original trial court was too heavy and unreasonable," but the court of appeals also dismissed the appeal, saying, "The defendant's allegation of misrepresentation is without reason, and the trial court's sentence against the defendant does not appear to be unreasonable."

"The accused walked down the street in broad daylight wearing only underwear and a plastic bag filled with bonds in his underwear," he said.

He continued, "Considering the fact that the accused has several previous criminal records and he does not reflect on his actions, the sentence of the trial court against the accused does not seem unreasonable."
