The 1st Criminal Division of the Jeonju Tribunal of the Gwangju High Court (Chief Judge Baek Kang-jin) imposed a fine of 5 million won in the first trial against a teacher A (57, female) who was charged with violating the Act on the Protection of Children and Juveniles (forced molestation), etc. It was announced today (20th) that the sentence of the sentence was postponed. 



Deferment of sentencing is a judgment that postpones the sentence for a certain period of time for a minor offense and makes it virtually non-existent after two years from the date of probation. 



Teacher A was charged with repeating sexually humiliating acts, such as groping the body of student B four times, at a middle school in Jeongeup, Jeollabuk-do from September 2019 to December of the same year. 



At that time, it was investigated that teacher A approached Miss B in the school hallway or the office and touched her body parts, saying, "I lost weight" and "It looks better." 



Ms. B is known to have stated in the police and prosecutor's investigations, "I was ashamed to touch (the teacher) in front of other people" and "I was embarrassed and angry because I kept repeating it." 



Teacher A, who was suspended for two months in this case, denied the charges at the trial, saying, "The student's effort to lose weight was unusual, so he touched and encouraged it."

The court of first instance sentenced Teacher A to a fine of 5 million won and ordered him to attend a sexual assault treatment program for 40 hours, saying, "The defendant was sexually abused and forcibly molested several times." 



However, the court of appeals suspended the sentence on the grounds of 'possibility of excessive disposition'. 



The court of appeals said, "Considering that it is difficult to see the accused as a sex crime committed to satisfy an individual's sexual desire, and that if the first trial sentence is finalized, he will retire and lose all of his career as a teacher," the court of appeals said. is too heavy and unfair," he said, explaining the reason for the suspension of the sentence.
