The Federal Customs Authority and the local customs departments in the UAE carried out 67 seizures of counterfeit goods that violate the intellectual property rights of original trademark holders during 2019, compared to 63 seizures in 2018, according to the Intellectual Property Rights Report for the year 2019 recently issued by the Authority.

Hand luggage accounted for 29.85% of the total seizures.

According to the report of the authority, the amount of goods seized in the field of intellectual property last year amounted to about 168 thousand and 251 pieces, compared to 169 thousand and 587 pieces in 2018.

The limited decrease in the number of seizures is due to the increase in small seizures by regular mail and express mail shipments, in light of the increasing growth in e-commerce traffic.

The Commissioner of Customs and Chairman of the Authority, Ali Saeed Matar Al Niyadi, affirmed the UAE’s keenness to protect intellectual property rights and confront any counterfeit goods that violate the rights of the owners of original trademarks from national and foreign companies, stressing the UAE’s full commitment to international agreements and national legislation in force in the field of intellectual property rights.

He added: “We in the UAE have a clear and comprehensive strategy to confront counterfeit goods and combat commercial fraud,” stressing that the customs institutions in the UAE are among the most important institutions entrusted with protecting intellectual property rights in international trade, in light of the responsibilities and powers entrusted to them, under the unified customs law of the GCC countries. The UAE has placed the protection of intellectual property rights among its strategic priorities, as part of its vision to build a competitive knowledge economy as part of the UAE Vision 2021.

The Federal Customs Authority developed a plan to publish annually the statistics and efforts that the UAE customs sector works on in the field of protecting intellectual property rights on the Authority’s website, where the first report on intellectual property seizures at the country level for the year 2019 was published on the authority’s website www.fca.gov .ae, during the past days.

Al-Niyadi said that the high level of cooperation between the customs sector in the country and international customs administrations in the field of exchanging information to help target the movement of prohibited and counterfeit goods has led to interventions and inspection campaigns carried out by customs departments at home and abroad, indicating that the authority applies 15 agreements for mutual customs assistance. And it is working on signing other agreements with its partner from the customs administrations around the world.

The report of the authority dealt with the classification of seizures in terms of product quality, indicating that 37.31% of the seizures fall into the category of other miscellaneous goods, while the share of handbags amounted to about 29.85% of the total seizures, followed by mobile phones and their accessories by 11.94%, then clothes by 7.46%. And perfumes and shoes by 4.48% each, and finally, accessories, lenses, glasses, watches and jewelry by 1.49% each.

Al-Niyadi praised the level of vigilance of observers and inspectors of the customs sector in the country, and their keenness to protect society and preserve the rights of business owners in the country and abroad from harmful commercial practices. He also praised the level of cooperation provided by international institutions, the private sector and local customs departments in the field of exchanging information and experiences about Shipments and goods that violate intellectual property rights.

The authority's report on intellectual property rights for the year 2019 classified the seizures in terms of means of transport, indicating that the percentage of counterfeit goods seizures that are transported by air transport out of the total seizures during the year amounted to 33%, followed by seizures of post and express mail by 31%, Maritime transport is 19%, and finally land transport 16%.

He explained that the authority and the local customs departments paid special attention to strengthening cooperation with the private sector in combating goods that violate intellectual property rights.

Al-Niyadi said that the customs sector in the country, in cooperation with the relevant companies, was keen to destroy the seized counterfeit goods, and to recycle them according to environmental controls, to protect society and the international supply chain, and take into account the environmental effects of destroying the seized goods.
