The user units carry out comprehensive investigation and rectification and supervision and law enforcement, and seriously investigate and deal with relevant units that have illegal production and sales of substandard products, illegal filling of gas cylinders, use of uninspected pressure pipelines and other illegal activities.
Now the third batch of 10 typical cases are exposed.
1. The case of Zhang from Bengbu City, Anhui Province suspected of selling substandard liquefied petroleum gas
Since November 2022, the Market Supervision Bureau of Bengbu City, Anhui Province has received multiple reports from the public, reporting that Zhang, the actual operator of the Heliu Yongshuai Gas Supply Station in Huaiyuan County and the Changyuchun Liquefied Gas Filling Station in the county, has been engaged in liquefaction for a long time. Dimethyl ether was illegally added to petroleum gas to make huge profits, and the inspection report provided showed that the (C3+C4) hydrocarbon component was 41.1% (technical requirement ≥ 95%), and the inspection conclusion was unqualified.
On December 6, 2022, the Bengbu Market Supervision Bureau of Anhui Province coordinated with the public security department to jointly dispatch more than 100 law enforcement officers to carry out unified law enforcement operations in Bengbu City, Huaiyuan County, Wuhe County and Si County of Suzhou City to control the persons involved on the spot. 18 people, destroyed 2 production dens, 6 distribution and storage dens, seized 5 vehicles involved, more than 300 liquefied petroleum gas bottles, and seized more than 50 tons of counterfeit liquefied petroleum gas and raw materials. The value of the goods involved at the scene was more than 1.5 million yuan.
In view of the above-mentioned behavior of the parties involved in the case, which violated the provisions of Articles 32 and 39 of the Product Quality Law of the People's Republic of China, and the amount involved was huge and suspected of constituting a crime, the Bengbu Municipal Market Supervision Bureau transferred the case to the Public Security Bureau in accordance with the law. The agency investigated and established a joint task force to investigate.
The joint task force found that since November 2021, in order to make huge profits and seize the liquefied gas supply market, the party involved, Zhang, purchased dimethyl ether, propane liquefied gas and other raw materials from Puyang, Henan, Fuyang, Anhui and other places, and used them in his business At two LPG stations, dimethyl ether was mixed into LPG and wholesaled in the name of mixed gas to more than 40 people including Wang, an offline retailer, with a total amount of more than 14 million yuan involved.
So far, the case has been investigated by the Longzihu Branch of the Bengbu City Public Security Bureau of Anhui Province, and all 51 parties involved have been submitted to the procuratorate for review and prosecution in batches.
2. Case of using uninspected pressure pipelines by Qinyuan County Coalbed Methane (Natural Gas) Gathering and Transportation Co., Ltd., Changzhi City, Shanxi Province

3. Hongfa Gas Co., Ltd. in Zigui County, Yichang City, Hubei Province failed to fill gas cylinders in accordance with safety technical specifications.
In May 2023, Hongfa Gas Co., Ltd. in Zigui County, Yichang City, Hubei Province was administratively punished for failing to conduct inspections and records before and after gas cylinder filling as required.
On September 19, 2023, the Market Supervision Bureau of Zigui County, Yichang City, Hubei Province discovered during a supervision and inspection that the parties knew that the gas cylinders they were filling did not have electronic reading marks (QR codes) and could not be filled through the electronic information management system. Despite the situation, 8 liquefied petroleum gas bottles were still filled.
The Market Supervision Bureau of Zigui County, Yichang City, Hubei Province imposed a fine of 150,000 yuan on the party concerned in accordance with Article 85 of the Special Equipment Safety Law of the People's Republic of China.
4. The case of selling gas stoves that do not meet national standards at Haitao Home Appliance Mall in Zhaodong City, Heilongjiang Province
On May 29, 2023, Shandong Tengxiang Product Quality Inspection Co., Ltd. conducted sampling inspections on the "HaDtaot" brand gas stoves sold at Haitao Home Appliance Mall in Zhaodong City.
The inspection conclusion issued by Shandong Tengxiang Product Quality Inspection Co., Ltd. is: After inspection, the heat load item does not meet the GB16410-2020 standard. 5. The case of Qinji Trading Store in Huaxian County, Anyang City, Henan Province, which produced and sold household gas stoves that did not meet national standards, infringed on the exclusive rights of registered trademarks, forged and used other people’s factory names, addresses and certification marks, and were not certified by CCC
On June 20, 2023, the Market Supervision Bureau of Huaxian County, Anyang City, Henan Province, based on clues, inspected the Qinji Trading and Distribution Store in Huaxian County in accordance with the law, and found on site that the "Supor New Generation" and "Jiayu Oppain Blue Realm" produced by it Brand household gas stoves and the 7 types of OPAICN brand household gas stoves purchased and sold do not have CCC certification certificates, purchase source and other supporting documents.
After investigation, the store has illegally processed and produced household gas stoves in its business premises since April 2022, producing 218 units and selling 124 units. All of them are not in compliance with national standards, have not been certified by CCC, are counterfeit, and use other people's factory names. Factory address and certification mark or products that infringe the exclusive rights of registered trademarks.
At the same time, the seven types of OPAICN brand household gas stoves purchased and sold by the parties were products that infringed on the exclusive rights of others' registered trademarks, were not certified by CCC, or used other people's factory names, addresses and certification marks.
On September 28, 2023, the Market Supervision Bureau of Huaxian County, Anyang City, Henan Province relied on Article 60 of the Trademark Law of the People's Republic of China, Articles 49 and 60 of the Product Quality Law of the People's Republic of China, and the According to Article 66 of the Regulations of the People's Republic of China on Certification and Accreditation, Article 4 of the "Decision of the State Council on Amending and Repealing Certain Administrative Regulations" and Article 28 of the "Administrative Punishment Law of the People's Republic of China", the party's illegal income of 5,504 yuan shall be confiscated. , confiscated 114 finished household gas stoves, 717 raw and auxiliary materials (packages), 895 packaging materials, and 2 production tools that were illegally produced and sold, and imposed a fine of 105,000 yuan.
6. The case of Jinming Petroleum Liquefied Gas Station in Liping County, Qiandongnan Miao and Dong Autonomous Prefecture, Guizhou Province filling cylinders that did not meet safety technical specifications and selling substandard liquefied petroleum gas.
During the "Crackdown on Illegal and Violators" campaign carried out by Guizhou Province in 2022, the Jinming Petroleum Liquefied Gas Station in Liping County was investigated for illegal activities of filling gas cylinders that did not meet safety technical specifications and selling products that did not meet national standards.
After investigation, it was found that the gas cylinders filled by the parties included scrapped gas cylinders, gas cylinders that exceeded the inspection cycle, gas cylinders with unknown inspection dates, gas cylinders without informational labels, and gas cylinders without self-closing valves that did not comply with national standards and gas cylinder safety technology. Gas cylinders required by the specifications; after sampling inspection of the company's filled gas cylinders and liquefied petroleum gas stored in gas storage tanks, the inspected item "C3+C4 hydrocarbon components" did not meet the requirements of the national standards and were all judged to be unqualified. Qualified products, the quantity of unqualified liquefied petroleum gas was 25.48 tons, the illegal value of goods was 222,900 yuan, and the illegal sales amount was 156,700 yuan.
The Market Supervision Bureau of Liping County, Qiandongnan Miao and Dong Autonomous Prefecture, Guizhou Province imposed a fine of 170,000 yuan in accordance with Article 85 of the "Special Equipment Safety Law of the People's Republic of China" and Article 49 of the "Product Quality Law of the People's Republic of China" According to the regulations, 5,564 kilograms of unqualified liquefied petroleum gas will be confiscated and a fine of 600,000 yuan will be imposed.

7. The case of selling household gas stoves without flameout protection devices at Yingzhou Yingzhan Hotel Supply Store in Lingshui Li Autonomous County, Lingshui County, Hainan Province

On September 19, 2023, the Comprehensive Administrative Law Enforcement Bureau of Lingshui Li Autonomous County, Hainan Province, in accordance with the provisions of Article 49 of the Product Quality Law of the People's Republic of China, confiscated 2 substandard household gas stoves from the parties and confiscated 140 yuan of illegal income. A fine of 1,860 yuan was imposed, and a total fine of 2,000 yuan was confiscated.
8. Case of selling substandard commercial gas stoves without Chinese warning instructions at Beijing Chengqian Trade Center (Liu Shouan) in Changping District, Beijing
On August 15, 2023, the Beijing Changping District Market Supervision Bureau inspected the business premises of Beijing Chengqian Trade Center and found that the commercial gas stoves sold by the party did not have product quality inspection certificates, and the product name, manufacturer name and factory address were not marked. There is no flameout protection device, and the product quality does not meet the requirements of relevant national standards; the fire gathering and windproof device products sold are not marked with the product name, manufacturer name and address, and there are no Chinese warning instructions such as safe use precautions.
After investigation, the parties concerned purchased 11 stoves that did not meet national standards and sold 1; they also purchased 3 fire-concentrating and windproof device products without Chinese warning instructions, but they were not sold.
On October 23, 2023, the Market Supervision Bureau of Changping District, Beijing, in accordance with Articles 49 and 54 of the "Product Quality Law of the People's Republic of China", confiscated the illegal gains and illegal property of the parties, and imposed a fine of 3,500 yuan.
9. Case of filling gas cylinders that did not meet safety technical specifications at Nansheng Gas Station in Hezhou City, Guangxi Zhuang Autonomous Region
On September 11, 2023, law enforcement officers from the Market Supervision Bureau of Hezhou City, Guangxi Zhuang Autonomous Region went to the Nansheng Gas Station in Hezhou City to conduct a law enforcement inspection. On the scene, they found that the party concerned was filling YSP35.5 specification cylinders with liquefied petroleum gas on the filling platform. During the operation, the 79 gas cylinders on the filling platform were not the gas cylinders registered for use by the parties concerned.
After investigation, among the 79 gas cylinders on site, a total of 29 gas cylinders have reached the end of life, and a total of 7 gas cylinders have exceeded the inspection period. By scanning the QR code of the gas cylinders on this site, the above 79 gas cylinders were recharged. Pack.
In accordance with the provisions of Article 85 of the Special Equipment Safety Law of the People's Republic of China, the Market Supervision Bureau of Hezhou City, Guangxi Zhuang Autonomous Region ordered the parties concerned to correct their illegal behavior and remove 29 of the 79 liquefied petroleum gas cylinders that had reached the end of life and those that were overdue for use. The 7 gas cylinders in the inspection period will be handed over to a gas cylinder inspection agency with inspection qualifications for processing in accordance with relevant regulations. 10. Sichuan Deyang Jinyan Gas Co., Ltd. failed to fill gas cylinders in accordance with safety technical specifications
On September 26, 2023, during an unannounced inspection of the special rectification work on urban gas safety in Deyang City, Sichuan Province, the supervision team found that the liquefied petroleum gas bottles distributed by Zou of Deyang Jingkai Gas Co., Ltd. had no relevant filling information after scanning the code.
After verification, the above-mentioned gas cylinders were filled by Deyang Jinyan Gas Co., Ltd. (hereinafter referred to as Jinyan Company).
On September 28, 2023, the Deyang Municipal Market Supervision Bureau and the Deyang Municipal Public Security Bureau conducted an on-site inspection of Jinyan Company. No filling records of the above-mentioned gas cylinders involved in the case were found in the Jinyan Company’s gas cylinder traceability platform.
After investigation, Jinyan Company violated the provisions of Article 109 of the "Criminal Procedure Law of the People's Republic of China" by using the system "backdoor" to control the computer information system. It was suspected of a crime and was investigated by the public security organs. Four persons were involved. Released on bail pending trial.
In accordance with the provisions of Article 85 of the Special Equipment Safety Law of the People's Republic of China, the Market Supervision Bureau of Deyang City, Sichuan Province imposed a fine of 200,000 yuan on Jinyan Company and included it in the list of serious violations and dishonesty in accordance with the law.
