The town hall can now impose a penalty of € 50 per day to force owners to evacuate a wrecked car. - IStock / City Presse

Some are dented, others have broken windows. Often tires, mirrors, license plate or engine are missing. Sometimes they are even charred carcasses. All these cars are what are commonly called wrecks.

However, to escape the costs and questions that would arise from their evacuation, motorists do not hesitate to abandon them anywhere.

The municipality at the front

The mayor has the legal power to have these carcasses removed. Any vehicle in the process of wrecking can indeed be impounded, whether it is in a public or private place, while it will be evacuated to an approved end-of-life vehicle center - breakage - s 'it is not repairable. However, in either case, the bill for removal must be paid.

To avoid bearing this cost which ends up weighing heavily on the municipal budget, the local authorities therefore begin by carrying out searches to find the holder of the gray card, before moving the vehicle. If it is identified, it is then put on notice to have it removed, knowing that it is also liable to a fine of 1,500 euros for the abandonment of a wreck.

An additional penalty

To encourage motorists to take their responsibilities, the law of December 27, 2019 for engagement in local life has hardened the tone. If the owner has not removed his car within the time limit, the mayor can now impose a penalty of up to 50 euros per day late, up to 1,500 euros. Please note, you are liable to this penalty even if the wreck is on private property. On the other hand, it must represent a risk for the safety of people or constitute a serious damage to the environment.

The problem remains for all cars abandoned without a license plate and whose owner remains unknown. In these cases, it is the municipality which must take care of evacuating the machine and paying the bill. It is not for nothing that certain carcasses remain on site for months, to the point of being part of the landscape…
