Article 31 of the new "Notice of the Guangzhou Municipal People's Government on Printing and Distributing Guangzhou's Resolutely Winning the New Crown Pneumonia Epidemic Prevention and Control Struggle and Efforts to Realize the Economic and Social Development Goals and Tasks of the Year" states that the promotion of the stable and healthy development of the real estate market. Optimize and improve the supervision of commercial housing pre-sale funds, and allow real estate development and operation enterprises to apply for the transfer of funds for commercial housing pre-sale special account funds with commercial bank cash guarantees. Increase support for the housing leasing market and speed up the allocation of bonus funds to housing leasing companies.

Compared with the old version of the policy released on the morning of March 3, Article 31 of the new version deletes the following: Optimizing the construction and sales management of commercial service projects. The minimum requirements for planning and construction of commercial service projects that have not completed planning and construction are no longer limited. Split unit; commercial service items are no longer limited to sales objects, and those who have already registered their rights are no longer limited to transfer objects.

In other words, Guangzhou commercial service projects still need to implement the minimum division limit of “building area of ​​not less than 300 square meters”, and personal purchase of commercial service projects is still limited.

According to Article 3 of the “Notice of the General Office of the People's Government of Guangzhou Municipality on Further Strengthening the Regulation of the Real Estate Market” (Suifu Office Letter [2017] No. 65) issued on March 30, 2017, the management of commercial real estate projects was strengthened. (1) Commercial service (commercial and office, the same below) real estate projects shall be developed, constructed, sold, and used strictly in accordance with the planned use, and shall not be changed to residential use without approval. (2) The minimum division unit of a new real estate project for a real estate development company that is reported to be a commercial service must not be less than 300 square meters. If it does not meet this requirement, the planning department will not approve it. If a real estate development enterprise violates the plan and changes a commercial service real estate project to residential use, once it is verified, it shall be dealt with seriously according to relevant regulations. (3) For real estate development enterprises selling commercial service properties, the sales target shall be a legal person unit; commercial service properties purchased by a legal person unit shall not be used for residence, and shall be transferred to a legal person unit when the property is transferred again. Prior to the implementation of this notice, commercial service properties that have been purchased can be transferred to legal entities or individuals; individuals can only transfer the property after they have obtained the real estate certificate for two years.

On December 19, 2018, the Guangzhou Municipal Housing and Urban-Rural Development Committee issued the Opinions on Improving the Sales Management of Commercial Real Estate Projects. This opinion is in accordance with Article 3 (3) of the above-mentioned policies issued on March 30, 2017. ).

According to the Guangzhou Housing and Urban-Rural Development Committee, Suifubanhan [2017] No. 65 "Commercial properties" as stipulated in "Real estate development companies selling commercial services properties should be sold to legal entities" refers to Commercial real estate projects with land transfer transactions after March 30 (2017) will not implement this provision for commercial real estate projects with land transfer transactions before March 30, 2017 (inclusive). This opinion has been implemented since December 20, 2018.

The policy released on December 19, 2018 is to "cut off the old and the new" for the sales targets of commercial service properties. Before March 30, 2017 (including the day), commercial real estate projects with land transfer transactions can be purchased by individuals and legal entities, and there are no restrictions on sales targets when re-transferring; and land transfer transactions after March 30, 2017 Projects can only be sold to legal entities, and re-transfers can only be sold to legal entities.

In fact, the policy of local government's loosening of control frequently shows the phenomenon of “one-day trip”. On December 10, 2019, multiple sales offices in Zhangjiagang, a county-level city under the jurisdiction of Suzhou, received news from the Municipal Real Estate Trading Center, saying that the house can be directly transferred for less than two years, and the "restriction on sale" requirement has been cancelled. However, on December 11, the staff of Zhangjiagang Real Estate Trading Center stated that the policy of “cancelling sales restrictions and transfers” had ceased.

On July 19, 2019, Kaifeng City issued a policy to abolish the transaction time limit for newly-built commercial houses that can be listed for transfer for three years from the date of obtaining the Real Estate Certificate, and to cancel the frozen time limit for transaction eligibility for revoked record houses.
