The head of the Court of Instruction number 4 of Pamplona considers that the racist insults received by the Real Madrid player Vinicius Júnior at the El Sadar stadium on February 18, 2023 "could constitute a crime", but has shelved the case due to the impossibility of identifying its perpetrators.

In the order, which can be appealed, the magistrate agrees to the provisional dismissal of the proceedings after the police failed to find out the identity of the perpetrator of the insults in their investigation.

This legal procedure was initiated by virtue of the complaint filed by the Liga de Fútbol Profesional for a possible criminal offence committed on 18 February last year during the match between Osasuna and Real Madrid.

"From what has been done, it is clear that the facts could constitute a crime, but there is not enough information to know the identity of the perpetrators," the document states.

Therefore, in accordance with the provisions of Article 641.2 of the Code of Criminal Procedure, the judge continues, "it is appropriate to agree to the provisional dismissal of the case and, in accordance with Article 634 of the same legal text, since there are no proceedings pending execution, the archiving of these proceedings".
