Enríquez Negreira and FC Barcelona are leading the biggest sports scandal in the history of Spain.

The former Primera referee and former president of the Referees Committee regularly charged, for 17 years and at the hands of four presidents of the Catalan club,

6.6 million euros

for services that are very difficult to explain, which are being investigated by various legal and sporting bodies .

Who is José María Enríquez Negreira?

Former Spanish referee attached to the Catalan school from 1975 to 1992. He spent thirteen seasons in the First Division and refereed 132 games.

Real Madrid is the team he whistled for the most times throughout his career, which ended in the Second Division.

Two years later, under the guidance of

Victoriano Sánchez Arminio

, he became vice president of the Technical Committee of Referees, a position he held until 2018.

How did the Negreira Case arise?

When the National Fraud Investigation Office (ONIF) of the Tax Agency begins to investigate the former arbitrator's company,

Dasnil 95 SL

, for alleged irregularities in their accounts.

Specifically, for the income of 1.6 million euros invoiced to the Barcelona Football Club during the years 2016, 2017 and 2018.

What does Dasnil 95 SL do?

The company is headquartered in a basement on Oblit street, in the Guinardó neighborhood of Barcelona and never had more than two employees.

Its corporate purpose is: "Advertising services for companies, promotions and gift items, printing texts and making sports videos for marketing".

However,

95.4% of their income came from FC Barcelona.

What services did Negreira provide to Barça?

The club delivered to the Tax Agency a package of 33 invoices issued by Negreira during the presidency of Josep María Bartomeu, whose concept was the "preparation and sending of technical videos to the club", or simply "technical video advice".

However, according to the Tax Agency and after the ex-referee's own statement before them: "Barcelona wanted to make sure that

no arbitration decisions were made against them

, that is, that everything was neutral."

Were they the only payments?

No, the services of Enríquez Negreira started in 2001 during the presidency of

Joan Gaspar

, continued with

Joan Laporta, Sandro Rosell

and would reach

Josep María Bartomeu

, who would stop paying Negreira in 2018, coinciding with his departure from the vice-presidency of the Technical Committee of Referees.

The total invoices amount to 6.6 million euros.

What does Javi Enríquez, the son of Enríquez Negreira, paint in all this?

From 2008 to 2015 Javi Enríquez acted as Mental Coach of the Technical Committee of Referees.

Some hired his services privately.

"In arbitration there is a lot of competition, they can raise you, they can lower you, and it could be good for you to hire the son of the vice president," former referee

Pérez Burrull

assured this newspaper .

Andújar Oliver,

from Almería

, recounts that it came to him that "in important Barcelona matches in his field, Negreira's son called the referees to ask them what hotel they were in, and took them to the field."

How did Negreira take that they stopped paying him?

He sent a burofax to the then president of Barça, Josep María Bartomeu, asking him to restore the payments or he would pull the plug causing a "scandal".

Negreira threatened to give him: "Publicity to all the irregularities that I have known and experienced first-hand in relation to the club", and that he would do it "without regard".

What can happen to Negreria and Barça criminally?

The payments could be considered a continuous crime of corruption between individuals, typified in article 286 bis of the Penal Code: "The director, administrator, employee or collaborator of a commercial company or of a company that, by himself or by an intermediary, receives , request or accept an unjustified benefit or advantage of any nature, or offer or promise to obtain it, for himself or for a third party, as consideration to unduly favor another in the acquisition or sale of merchandise, or in the contracting of services or in commercial relations, will be punished with

imprisonment from six months to four years

...".

And sportingly?

In accordance with article 30 of the new Sports Law, which came into force on December 31: "Infractions and sanctions will prescribe, according to the provisions of the laws that establish them. If these do not set prescription periods, the infractions very serious will prescribe after three years, serious ones after two years and minor ones after six months".

However, if the investigations of the Prosecutor's Office were to prove a crime of corruption between individuals, the sentences could even have consequences on the legal person, in this case Barcelona.

The suspension of activity is in the range of sentences.

It was one of those requested by prosecutors in the

Neymar case.

For Barcelona it would mean not being able to take part in competitions.

What do the clubs say?

All the clubs except Madrid and Barça describe the Negreira case as "maximum seriousness".

LaLiga and its Delegate Commission "reject and repudiate the facts, and are deeply concerned and actively working to clarify any irregularities that may have occurred around the Negreira case, whether sporting or of any other nature," they said in a statement.

The president of La Liga,

Javier Tebas

, admitted that if the Prosecutor's Office accuses Barça and Negreira of corruption between individuals, they will appear in the case in the corresponding court.

And the same is true of the Spanish Football Federation, which began a process of confidential information with requirements to Barça and the Technical Committee of Referees (CTA).

And the government?

Even the President of the Government,

Pedro Sánchez

, has ruled on the subject: "We are going to wait for the bodies in charge of the good governance of the League, in this case the Spanish one, to clarify the situation that, unfortunately, we are learning from the media".
