The trial of the Brazilian star Neymar came to an end on Monday, a few days after the major transformation that took place in the case of the Brazilian international transfer to Barcelona from Santos in 2013 as a result of the prosecutor's decision to drop the fraud charges against him.

Despite the bombshell detonated by the Public Prosecution Office last Friday by dropping the charges against the Brazilian player, the case is still open, because the Barcelona court is also considering a lawsuit brought by the Brazilian sports investment company DES, alleging that it was defrauded in the transfer deal that it It took place in 2013 between Santos and Barca.

The trial is the culmination of a legal saga that lasted for years, and Neymar was one of nine defendants in the fraud case, including his parents and their company "N&N", which manages the affairs of the current star of Paris Saint-Germain.

The investigation into the transfer deal began after a complaint lodged in 2015 by DES, which owned 40% of the sporting rights to the player's contract when he was at Santos.

The company alleges that there was collusion between Neymar, Barcelona and the Brazilian club to conceal the true cost of his transfer to the "Camp Nou", and thus it was subjected to financial fraud.

Neymar and his parents, along with the rest of the defendants, will be given the opportunity to address the court by video link before the end of the day.

Spanish prosecutors were demanding a two-year prison sentence for Neymar, and a fine of the 30-year-old player 10 million euros ($9.9 million).

But in a dramatic turn of events last Friday, the public prosecutor said he had dropped all criminal charges against the defendants on the grounds that there was not enough evidence to prove a crime had been committed.

The public prosecutor went ahead with the case after agreeing to DES's allegations that it had been defrauded during this transaction, but then saw that the allegations were not based on evidence but on "assumptions", and concluded that the case was a civil case, not a criminal case.

Although the trial phase comes to an end on Monday, the final ruling could take several weeks.

The public prosecutor's position has changed

In 2015, DES filed a complaint in Spain against Neymar, Barcelona and Santos alleging fraud, claiming a €35 million refund.

Barcelona claimed that the transfer deal cost him 57 million euros, including 40 million for "N&N", and 17 million for Santos, who paid 6.8 million euros of his share to DES.

Spanish prosecutors initially said they believed the actual value of the deal was at least 83 million euros.

But after the bomb last Friday, DES contested the prosecutor's position that no crime had been committed, and its lawyer, Eliseo Martinez, said, "We can't agree with that (the prosecutor's decision). If that was the case, this trial would not have started." .

However, the company softened its position somewhat by demanding that Neymar be imprisoned for two and a half years if found guilty, instead of 5 years.

Sources close to Neymar's legal team said that the Brazilian star's lawyer will ask the court to compel DES to pay all legal costs of the trial on the basis of acting "recklessly" and "bad faith".

On the second day of the trial, which began on the 17th of last month, Neymar said he did not remember whether he was involved in the negotiations to move to Barcelona, ​​claiming that he only signed the documents provided to him by his father.

All the other defendants, including former Barcelona presidents Josep Maria Bartomeu and Sandro Rosell, have denied any wrongdoing.
