Due to the increase in electric scooters in urban areas, and at the request of local police, the General Directorate of Traffic (DGT) has published a transitory instruction for the users of these vehicles that must be applied by the municipalities until an approval is approved. Royal Decree that continues to be delayed due to the lack of government.

According to this instruction, all personal electric mobility scooters and devices that have a maximum speed between 6 and 25 km / h will be considered Personal Mobility Vehicles (VMP) . Those that do not exceed 6 km / h will be considered toys and those that exceed 25 km / h will be totally prohibited under a fine of 500 euros .

Scooter users will not be required to have a driver's license or insurance, so they will not be deducted points in case of infringement, but they will have to undergo alcohol and drug tests , with fines between 500 and 1,000 euros In addition, if the driver is positive for alcohol or drugs, the VMP will be immobilized, as is the case with other vehicles.

Driving using the mobile phone or any other communication system, as well as the use of headphones or headphones connected to receiving devices or sound players, will be prohibited. In all these cases, the penalty will be 200 euros.

Electric scooters will be prohibited from moving on sidewalks and pedestrian areas , being punishable by 200 euros, and may only transport one person, so the movement of two people is punishable by a fine of 100 euros.

As for the use of the helmet and other protective elements, it will be governed by what is provided by the corresponding Municipal Ordinance. Fines can amount to 200 euros and the vehicle will be immobilized.

Night driving

At night it will be mandatory to circulate with lighting and garments or reflective elements; otherwise it will be considered negligent driving and, therefore, punishable by a fine of 200 euros. The regulation regarding stops and parking on the sidewalk will be exclusively municipal, although the DGT advocates that the sidewalk be pedestrian.

Finally, in the case of infractions committed by persons under 18 years of age , the parents, guardians, welcoming and legal guardians or in fact will be jointly and severally liable for the infraction committed by the minor.
