• Thebes vs. Rubiales. The judge will make a decision in the next five days on schedules

LaLiga has denounced before the Higher Sports Committee (CSD) the commission of a "very serious infraction" by the president of the RFEF, Luis Rubiales , his general secretary, Andreu Camps , and the competition judge, Carmen Pérez , for his performances in the known as 'case Schedules'. The institution chaired by Javier Tebas argues that there has been an "abuse of authority" by these three members of the federative entity, an infraction that according to article 79.1 of the Sports Law would entail the temporary or definitive disqualification of these three leaders, in If the accusation is proven.

The complaint was filed with the CSD last week. The procedure dictates that the three defendants enjoy 10 business days to present the allegations they deem appropriate, a period that remains open. Thereafter, a period is opened without defined deadlines for the CSD to study both the complaint and the allegations and adopt a resolution, something that will never occur before LaLiga begins and probably not during the month of August.

This movement of the employer has been announced by LaLiga while in the Commercial Court number 2 of Madrid the hearing was held to determine if the employer has full competence to freely set the schedules of the parties or if the RFEF can circumscribe its dispute on specific calendar days, as it intends to impose, prohibiting its celebration on Mondays and Fridays.

Friday's Ahtletic-Barcelona

During the hearing, which lasted almost four hours, the parties have presented their arguments before Judge Andrés Sánchez Magro . In the long term, LaLiga, who is the one who has taken this issue to court, hopes that this court will recognize full competence in terms of schedules. Shortly, he hopes that the precautionary averages will allow the competition to start next Friday with Athletic-Barcelona on the first day of the First Division.

Although the judge has five business days (that is, until next Wednesday) to announce the possible precautionary measures, he plans to do so "between tomorrow and the past," as he briefly explained to the media. LaLiga expects that, given the economic impact it would have on clubs not to play on Fridays and Mondays, the judge will allow to keep the calendar lying down by the competition judge, hired by the RFEF.

The federative entity has shown during the hearing its disagreement with the trial being held in a Commercial Court, rather than in a Contentious-Administrative Court. In any case, the RFEF lawyer has affirmed that the institution that presides over Rubiales will comply with the precautionary measures adopted by the judge, after rumors to the contrary that they have traveled Spanish football during these last days. "It was an interested rumor," said Camps.

"From 30%"

One of the most outstanding testimonies of the day has been that of the president of Mediapro, Jaume Roures , cited as a witness by LaLiga. The Catalan businessman has for the first time put a figure at the negative economic impact that a favorable decision to the RFEF would have for the clubs. According to their testimony, the winners of the television rights would renegotiate their contracts downwards "from 30%" of the current contracts, legally subject to parties on Fridays and Mondays. A debacle for clubs, whose dependence on television money in some cases exceeds 90% of their annual budget.

The RFEF lawyer has reproached LaLiga for including these strips in the bases for the award of television rights, despite the fact that the coordination agreement that included them expired on June 30. However, outside that agreement nothing indicates when the matches are to be played. In other words, and following the RFEF thesis, without an agreement in force, LaLiga also could not have sold parties on Saturdays and Sundays.

"To the braves"

About its silence during the process of drafting the bases, which includes Mondays and Fridays as business days, the RFEF is shielded in that the period of allegations coincided in time with the entry into prison of those who then they were its president and vice president, Ángel María Villar and Juan Padrón . From the federation they also denied that it is a matter of money, although Rubiales opened the door on Fridays (not on Mondays) if LaLiga increased his contribution to the RFEF.

LaLiga, apart from defending that Royal Decree Law 5/2015 gives them full competence to set the schedules of the First and Second parties, has accused the RFEF of violating the right of competition and of acting "to the brave" in an issue that has united all clubs (except Real Madrid) against Rubiales.
