The Ministry of Human Resources and Emiratisation has warned private sector establishments registered with the ministry against committing a violation of "sham Emiratisation", by manipulating data or procedures for employing citizens with them, with the aim of circumventing the package of decisions issued by the UAE government, which obliges establishments that employ 50 or more workers to localize. 2% of its skilled jobs annually for five years.

She stated that in the event that a violation of sham localization is proven, fines will be imposed against these companies, while if it is proven that the employer committed a violation of fictitious localization by “deliberate and fraud”, he will be referred to the Public Prosecution to take action in accordance with the legislation approved in the country.

The ministry confirmed that its inspectors carry out inspection visits to all facilities at the level of the emirates, where the inspector fills in the inspection form and is required of the visit through the inspection system, and then prepares the violation report (if any violation is detected) in accordance with the requirements of the inspection mission, and provide evidence and supporting images, After that, the inspection report and the violation report are reviewed and approved by the official, and finally, the violation report and the fine, if any, are approved by the office manager.

She stated that the percentage of Emiratisation determined for each facility is calculated by the total number of citizens working in the facility in relation to the total number of skilled workers, so that at least one citizen is appointed for every 50 skilled workers or part of the 50, for each year of application.

The Ministry classifies establishments and employers in the private sector into three categories according to the extent of their commitment to achieving the Emiratisation objectives. It has annual Emiratisation rates in accordance with Cabinet decisions at a rate no less than three times the target, and cooperate with the Emiratis Competitiveness Council (Nafes) in hiring and training their nationals with a number of no less than 500 citizens each year.

While companies are classified in the second category, if they comply with all procedures related to fees established by Federal Law 33 of 2021, its executive regulations, and all decisions issued by the Ministry of Human Resources and Emiratisation, regarding work permits and contracts for citizens and others, and the wage system, in addition to commitment to the force planning policy labor market, by promoting cultural and demographic diversity in the country's labor market.

The third category is concerned with establishments that are not committed to the manpower planning policy, by promoting cultural and demographic diversity in the labor market in the approved country.
