  The work report of the Supreme People's Procuratorate was submitted to the second session of the 14th National People's Congress for review on the 8th.

Supervise handling of cases: Don’t tolerate mistakes if they are not in vain, correct mistakes if they happen

  "We focus on the main responsibility of supervising and handling cases, and insist on correcting mistakes without any mistakes," Yuan Ming said.

  For this year, Yuan Ming said that the serious crime prosecution department will fully and accurately implement the criminal policy of combining leniency with severity and handle every case with high quality and efficiency.

"Promote the construction of an evidence-centered criminal charging system and give full play to the role of pre-trial filtering and proof of crime," he said.

  He also said that the serious crime prosecution department will further improve the legal supervision of death penalty review, improve the quality and efficiency of criminal trial supervision, promote the application of intelligent auxiliary case handling systems for criminal trial supervision, and strengthen big data-empowered criminal protest work.

Drug Crime: Ensure that drug-related cases are punished as they are punished

  In recent years, the number of drug crime cases prosecuted by procuratorial organs has generally been declining, but new drug crime cases have bucked the trend and have increased.

Prosecutors also found that drug-related crimes related to scheduled narcotics and psychotropic drugs other than traditional drugs were on the rise.

  "We perform our duties of arresting and prosecuting in accordance with the law and severely crack down on various drug crimes." Yuan Ming said that in 2023, procuratorial organs across the country arrested more than 41,000 people for drug crimes and prosecuted more than 44,000 people for drug crimes.

  Yuan Ming said that during this period, the procuratorial organs have strengthened litigation supervision to ensure that drug-related cases are punished as crimes; they have strengthened supervision of case filing and investigation activities, timely pursued and prosecuted missed criminals, and guided investigation agencies to comprehensively collect and improve evidence.

  In 2023, procuratorial organs across the country intervened in more than 3,700 major drug crime cases in advance, supervised the filing of more than 2,200 cases; corrected more than 1,300 missed arrests; corrected more than 1,000 crimes that were transferred for prosecution and missed, and corrected and missed more than 2,400 accomplices.

  It is worth noting that in response to the use of mail and delivery channels to commit illegal crimes such as drug trafficking, the Supreme People's Procuratorate issued "Procuratorial Recommendations No. 7" to the State Post Bureau in October 2021.

In May last year, the Supreme People's Procuratorate and 17 departments including the State Post Bureau jointly launched a special campaign for safe delivery to deepen the special management of safe delivery.

Safety in production: The number of cases involving dangerous work crimes is growing rapidly

  In 2023, the procuratorial organs punished crimes endangering production safety in accordance with the law and prosecuted a total of 4,750 people.

  Yuan Ming said that since the addition of the Criminal Law Amendment (11) in 2021, the number of cases of dangerous operation crimes has increased rapidly and has become the "number one crime" in cases that endanger production safety.

In this regard, the Supreme People's Procuratorate has strengthened case analysis and judgment, and organized 10 provincial procuratorates with large caseloads to hold business data analysis video conferences to study practical measures to improve the quality and efficiency of case handling.

  “Except for dangerous work crimes, criminal cases endangering production safety have declined year-on-year, but cases causing mass deaths and injuries do occur from time to time,” Yuan Ming said.

  The Supreme People's Procuratorate's "Serious Case Team" was immediately listed to supervise, follow up and provide guidance on major liability accident cases such as the major fire accident case at Beijing Changfeng Hospital and the fire accident case at Shanxi Yongju Coal Mine. It actively responded to social concerns and ensured the effectiveness of case handling.

  In the process of handling cases that seriously endanger production safety, procuratorial organs at all levels, while pursuing the criminal responsibility of those involved in the case in accordance with the law, strengthen the management of the source of prosecution, urge relevant functional departments to strengthen supervision, and guide enterprises to plug leaks and establish systems.

  Yuan Ming said that in order to promote the implementation of the "Procuratorial Recommendation No. 8", the procuratorial organs combined with the compliance reform pilot work of the enterprises involved in the case, actively carried out compliance inspections of the enterprises involved in the case, and promoted the enterprises to improve safety production-related systems and mechanisms.
