Lawyers told Emirates Today that there were cases detected in several countries of people who did not adhere to the quarantine, and caused the virus to spread in their surroundings, and others deliberately hurt others by touching surfaces or elevators, or leaving their saliva on them, indicating that these actions may lead to the death of a person Not only was he injured, and the Emirati legislator did not ignore it, and his punishment in certain cases amounts to imprisonment and a fine, according to an estimate of the crime committed by the judge.

The Attorney General of the State, Counselor Dr. Hamad Saif Al Shamsi, stated that violating the instructions and procedures issued by the competent authorities in the state to limit the spread of the Corona virus as one of the communicable diseases is considered a crime according to the laws of the state. In this context, every person coming to the state must adhere to the duration of the home quarantine in his place of residence for 14 days, and implement the instructions issued later by the competent authorities, and the person’s violation of the procedures of the home quarantine, leaving his place of residence and interfering with others is a violation of the provisions of law and public order, and a compromise of validity Society and its safety are at risk, and the Public Prosecution will strictly apply the law to anyone who violates these instructions. The Public Prosecutor called on citizens and residents to abide by the instructions and decisions issued by the relevant authorities in the state, in order to ensure their safety, and so that they do not fall under the jurisdiction of the law.

In detail, attorney Ali Musabeh said that the Penal Code contains articles that can be applied in relation to these behaviors. Article 339 of the Federal Penal Code stipulates that "he shall be punished by imprisonment and a fine for any person who assaults the integrity of another's body by any means and the attack leads to his illness or inability to do his personal work for a period exceeding Twenty days.

Accordingly, if the injured person refrains from treatment or intentionally infects others, despite his knowledge of his illness, he is punished according to the previous article.

He added that if the infection results in the death of the person from whom the disease was transmitted from the accused, whether intentionally or unintentionally, in light of his knowledge of the seriousness of this infection and the severity of the disease, then he is punished according to the provision of Article 342 of the same law that states that he is “punished with imprisonment and a fine or one of these two penalties Whoever mistakenly caused the death of a person.

He pointed out that the penalty shall be imprisonment for a period of no less than a year and a fine if the crime occurred as a result of a violation by the perpetrator of what is imposed on him by the assets of his job, profession or craft, or he was under the influence of drunkenness or anesthesia when he did so, or he refrained from assisting the victim or from seeking assistance to him with his ability that.

The penalty shall be imprisonment for a period of no less than two years and not exceeding five years, and the fine if the act results in the death of more than three persons. If another circumstance is provided in the conditions mentioned in the previous paragraph, the penalty shall be imprisonment for a period of no less than three years and not more than seven years and the fine . "

Musabeh emphasized that there is a moral obligation for any person who suffers from this infection, which is not a disgrace or a disastrous thing, as the whole world suffers from this epidemic, and as long as the person has good immunity, he will not be affected by the virus, and he will recover, so he in return must act. With a degree of responsibility, he is obliged to quarantine if he is forced to do so, or he is subject to examination directly if he signs symptoms of infection on him.

For his part, lawyer Mohamed Al-Reda told Al-Emarat Al-Youm that Article 348 of the Penal Code stipulates that whoever intentionally commits an act that endangers people's lives, health, security, or liberties is at risk. The penalty is imprisonment and a fine, or one of these two penalties.

The penalty shall be imprisonment if the act results in any harm whatsoever, without prejudice to any more severe punishment determined by law.

He added that a person should not underestimate this behavior, as getting involved in it even if it is a matter of underestimation or lack of appreciation of its consequences, is extremely dangerous, because a single casualty can be a cause of injury to dozens of others, and there is no doubt that this epidemic that has spread throughout the world started from only one person.

He stressed that the state has taken all measures to contain this virus and limit its spread, so members of society should have their responsibilities, especially those infected with or suspected of being infected with the virus.

He explained that the symptoms of the virus have become known to all, so there is no justification for claiming ignorance of them, so it is necessary for any person suspected of being infected with the virus to seek medical examinations, or isolate himself until his condition is confirmed, and he is not supposed to mix with people, subject to them. At risk, exposing himself to accountability if his knowledge is proven to be injured or suspected of being injured.
