The Osaka High Court in two courts sued the state that those who were forced to undergo sterilization under the former Eugenics Protection Act were deprived of the constitutionally guaranteed dignity of individuals and the right to have and raise children. Judge Akira Ota revoked the judgment of the first instance that dismissed the complaint and ordered the government to compensate.


In similar trials filed nationwide, the rulings handed down so far have ruled that the former Eugenics Protection Act is unconstitutional, but all of them have rejected the complaint and the national government. This is the first judicial decision to find liability.
