A man in his 30s who went upstairs with a weapon to threaten minors and hit them for making noise was commuted at the appeals court.



According to the legal community today (27th), the Daejeon District Court Criminal Appeal Division 2 (Chief Judge Choi Hyeong-cheol) sentenced A (36) to 1 year and 6 months in prison in an appeal trial for charges such as special injury, special threat, and home invasion. He broke a lower court and was sentenced to 1 year and 6 months in prison and 3 years probation.



On May 22, around midnight, Mr. A, who was in an apartment in Gongju, Chungcheongnam-do, where his parents live, went upstairs with two weapons to protest against noise between floors.



At the time, B (15), who was with friends and others in the upper house, heard Mr. A kicking the front door several times and opened the door.



Then, Mr. A entered through the open door and invaded the living room, swearing because it was noisy.



He also threatened to stab C (15), B's friend, with a weapon, and hit D (15), who was sitting in the living room, on the head with a weapon, inflicting three weeks of pre-treatment wounds.



However, it was revealed that Mr. A had never had a conflict with the victims prior to the crime of this incident, and that he had never reported it to the security office or management office.



In the end, to Mr. A, who stood in court, the first trial court said, "In view of the fact that he threatened many victims who were minors who were only 15 years old, causing extreme fear and striking the victim's head with a weapon and inflicting not light wounds, it is not a sentence of imprisonment. It is inevitable.” He was sentenced to 1 year and 6 months in prison.



Afterwards, Mr. A appealed for unfair sentencing, and the appellate court, which reviewed the case, said, "We took into account the fact that the defendant admitted to the crime and deeply regrets it, and that he had no history of criminal punishment other than a minor fine in the past." sentenced to probation.
