In December 2017, Mr. A was handed over to trial on charges of suffocating and killing Mr. B while arguing with Mr. B, who had suffered from brain lesion grade 2 disability in a car accident, over the morning prayer.



After Mr. B got into a car accident in 2007, he became unable to move on his own. Mr. A took care of Mr. B for 10 years, even receiving stool and urine from Mr. B. Although her husband suffered financial difficulties due to the annual hospital bill alone of 7 million won, Mr. A quit her job in 2017 and devoted herself to taking care of her.



However, Mr. B, who had been bedridden for 10 years, urged Mr. A, "Let's pray together for 3 hours from 5 am every day." .



In the neck area of ​​Mr. B, who died, there was peeling of the skin, local hemorrhage of the muscle, fracture of the cartilage, and there were also wounds on the facial skin and cheek mucosa. In the courtroom, Mr. A claimed that he had hit Mr. B's cheek and neck while expressing pain and dissatisfaction the night before the incident, but he did not strangle Mr. B or cover his nose and mouth.



In response, the first trial acquitted him, saying, "It is difficult to believe that Mr. A intentionally strangled his throat and blocked his nose and mouth to cause the victim's death without a reasonable doubt."



However, the second trial admitted that Mr. A was guilty of murder.

After examining the possibility that Mr. B died from disease, accident, and self-harm, he saw it as a murder.



The fact that there were more than 10 wounds that looked like nail marks on the face of Mr. B, who died, and the fact that a wound on the cheek mucosa was found in the mouth, where almost no teeth were found, was the basis for the assumption that there was an external force that caused the death.



The second trial judge also determined that A, who had suffered from depression and financial difficulties due to long-term care, frequently bumped into Mr. B, which may have acted as a motive for the murder.



While noting that "a severe sentence is inevitable," the second trial court said, "Mr. A had to go through economic and mental difficulties due to caregiving, and the victim's older brother and younger brother want mercy and neither do their children want punishment." He was sentenced to two years and six months in prison, which was lower than the sentence standard.



After examining the judgment of the second trial, the Supreme Court confirmed that there was no problem.
