Legislative Affairs Committee of the Standing Committee of the National People's Congress: The filing and review work will not be "big things and small things"

Beijing, 12 Dec (ZXS) -- The Standing Committee of the National People's Congress (NPC) voted on 29 December to adopt a decision on improving and strengthening the filing and examination system, further systematically standardizing the system, which has been in effect for many years.

Talking about the decision and the related work of the filing review, Yan Dongfeng, director of the Legislative Affairs Committee of the Standing Committee of the National People's Congress, said that the filing and review work insists on correcting mistakes, and will not "turn big things into small things and small things".

Filing and review is a constitutional supervision system with Chinese characteristics, and an important system to ensure the implementation of the Constitution and laws and maintain the unity of the country's rule of law. According to the decision, administrative regulations, supervision regulations, local regulations, and judicial interpretations are all within the scope of the NPC Standing Committee's filing and review.

Since the reform and opening up, with the continuous improvement of China's rule of law system, the filing and review system has been gradually established and developed. Since the 2015th National Congress of the Communist Party of China, especially after the revision of the Legislation Law in <>, the filing and review systems have become more mature and finalized. Last year, the report of the <>th National Congress of the Communist Party of China clearly stated that the filing and review system should be improved and strengthened.

As the specific executive department of the Standing Committee of the National People's Congress for filing and review, the Legislative Affairs Commission has reported to the Standing Committee on the work of filing and review for seven consecutive years. Some of the typical cases listed in this year's report have recently become one of the focuses of public opinion.

Yan Dongfeng believes that the outside world's attention to the record review work reflects the importance of this work.

He further introduced several forms of filing and review work carried out by the Legislative Affairs Commission: according to the application review, according to the relevant state organs, social groups, enterprises and institutions and citizens in accordance with the written review requirements or review suggestions of the normative documents;

Take the initiative to review administrative regulations, local regulations, and judicial interpretations submitted to the Standing Committee of the National People's Congress for the record;

Special review, focusing on a certain type of normative documents to carry out centralized review;

transfer for review, transfer to other filing and examination organs for review, or transfer from other filing and examination organs to the Legislative Affairs Commission for review;

Joint review, joint investigation and joint review of certain types of normative documents with other filing and review authorities.

These review methods are also regulated in the decision.

For example, if the formulating organ fails to revise or repeal a regulation or judicial interpretation in accordance with the written review opinion or handling plan, the special committee of the NPC and the working body of the NPC Standing Committee may put forward relevant bills and suggestions in accordance with the law, and the chairmanship meeting shall decide to submit them to the Standing Committee meeting for deliberation and decision.

Yan Dongfeng used "long teeth" to describe this system design. He stressed that the record review work is to find problems and solve them, and this work will not be "big things into small things, small things".

It is worth noting that many countries in the world have constitutional review or unconstitutional review systems, but the political systems, subjects of review, and objects of review vary from country to country.

Yan Dongfeng believes that China's filing and review system is an important part of the people's congress system, which is the essential difference from the relevant systems in other countries. He said, "The unique effectiveness of China's filing and review system is gradually emerging. (ENDS)
