The Federal Ministry of the Interior plans to tighten the deportation rules. The Ministry's two discussion drafts "on the improvement of repatriation and on data transfer regulations in immigration and social law" are primarily concerned with ideas for improvement in the enforcement of entry and residence bans as well as the deportation of criminals and endangered persons. The discussion drafts are to be the basis for further discussions with the states and municipalities in order to develop a draft law.

Federal Interior Minister Nancy Faeser (SPD) proposes, among other things, an extension of the exit custody from currently up to ten to up to 28 days in the future. This is intended to give the authorities more time to prepare for deportation.

"Under strict conditions under the rule of law", the officers should also be allowed to enter other premises in the event of deportation. This is to ensure that those affected are actually found in shared accommodation, it was said. In addition, entry and residence bans as well as residence requirements and spatial restrictions are to become immediately enforceable in the future and thus become more effective.

In order to relieve the burden on immigration authorities, the ministry is also proposing a longer validity of, among other things, residence permits in the asylum procedure and residence permits for persons entitled to subsidiary protection. People whose asylum applications have been rejected, but whose life or health in their country of origin is threatened, are therefore likely to stay longer in Germany.

According to the plans, the Central Register of Foreigners will also record in the future whether someone receives state benefits that secure their livelihood, which authority is responsible for this and over what period they are granted. This is intended to relieve the burden on immigration authorities, social welfare offices or job centres by eliminating the need for manual queries.
