It was on August 30, 2021 that one of the sons in a family shot two men in the yard below the apartment building in Hjulsta. One man died and the other was seriously injured. In connection with the incident, the property was also shelled from the farm.

The landlord Hjulstahem argued that the incident constituted a particularly serious disturbance according to the law and terminated the parents' contract on the rental apartment.

The parents argued that they should not be punished for anything their son had done, but the rent tribunal sided with Hjulstahem and considered the termination to be correct.

Court of Appeal: Right to evict

The parents appealed the verdict to the Court of Appeal, arguing, among other things, that the son who shot no longer lives in the apartment. The son was sentenced in 2022 to 13 years and ten months in prison for this shooting and another fatal shooting in the area.

Now the Court of Appeal has ruled that the shooting in question exposed the neighbors to danger and discomfort and that the housing company has the right to terminate the lease. The remaining family should therefore move out with immediate effect.
