The UAE digital government has confirmed that a worker in the private sector, who is affiliated or regularly studying in one of the educational institutions approved in the country, may be granted a paid study leave for 10 working days per year, to perform the tests, provided that the period of service with the employer is not less than two years. .

She stated that there are nine leaves that may be granted to the worker: annual leave, sabbatical leave to perform national service, study leave, mourning leave, Hajj and Umrah leave, maternity leave for female employees in the private sector, parental leave, sick leave in the labor law - the private sector, as well as For scheduled holidays and vacations.

And regarding the mourning leave, she mentioned that the employee in the private sector deserves a paid mourning leave, for a period of five days, in the event of the death of the husband or wife, and three days in the event of the death of any of the mother or father, or one of the sons, or brother or sister, or one of the grandchildren or grandfather or grandmother, and the leave is due from the date of death.

And in 2020, a federal decree was issued to amend some provisions of the law regulating labor relations, through which workers in the private sector are granted paid leave to care for their child, and thus the UAE will be the first Arab country to grant parental leave to workers in the private sector.

The decree by a federal law stipulated granting workers in the private sector a paid “parental leave” for a period of five working days to care for his child, which is due from the date of the child’s birth until he completes six months.

The national employee is also entitled to a sabbatical with paid leave to perform the national service, in accordance with the legislation in force in the country.

A female worker in private sector companies in the country is entitled to a 60-day maternity leave, as follows: the first 45 days with full pay, the next 15 days with half pay, and the employer must grant the female worker maternity leave, whenever she requests it, at any time, starting from the last day of the previous month Directly on the month in which the birth is expected, according to an approved medical certificate.

After exhausting the above-mentioned maternity leave, a female worker may stop work - without pay - for a period not exceeding 45 consecutive or intermittent days, due to an illness that has afflicted her or her child as a result of pregnancy and childbirth.

The illness is proven by a medical certificate issued by the competent medical authority, and this period does not fall within the period of service for which the female worker is entitled to the end of service gratuity, or the period of participation in the retirement system in accordance with the legislation in force in this regard.

A female worker in the event that she gives birth to a sick child or of “people of determination” (with disabilities), and his health condition requires an escort, according to a medical report issued by the medical authority, has the right to a 30-day leave with full pay starting after the end of the maternity leave period, and she has the right to extend the leave for another 30 days without pay.

After returning from maternity leave, a female worker is entitled, for a period not exceeding six months from the date of delivery, one or two rest periods to breastfeed her child, provided that the two periods together do not exceed one hour, and the nursing break shall be paid.

The employee is also entitled to an annual leave with full pay, not less than his leave balance of 30 days for each year of his service, and he is entitled to two days for each month if his service period is more than six months and less than a year, and in the event that the employee’s service ends before using the annual, in this case The employee is entitled to leave for the parts of the last year he spent at work.

The part-time employee is entitled to an annual leave according to the actual working hours spent with the employer, the duration of which is determined in the work contract, as determined by the executive regulations of the Labor Law.

The law grants the Muslim employee the right to obtain leave to perform the obligatory Hajj. Hajj leave is granted without pay for only 30 days, and is granted once throughout the employee’s period of work with the employer.

The UAE Labor Law did not include any provisions regarding the employee’s obtaining an Umrah leave, and if the employee requests this, the employer is free to approve or not, or deduct it from the employee’s annual leave, or consider it unpaid leave.
