In detail, the Court of Appeal stated in the merits of the ruling that the case, as it settled in its certainty, consisted of a dispute between the victim and the first accused (a businessman), and his partner, the second accused, over sums of money related to the sale of mobile phones, so they agreed with other defendants (Asian). To lure the victim, detain him and threaten him with death, until he complies with their will and returns the sums or merchandise.

She indicated that the victim went to the office of the first and second defendants to solve the problem amicably, and when he arrived, he was surprised by a person closing the office door from the inside, and asked him about the goods. From the amount of 100 thousand dirhams, he called a friend of his and asked him to provide the required amount, and the latter responded to him and handed them 100 thousand dirhams.

In the investigations of the Public Prosecution, the victim said that the defendants asked him for an amount exceeding the value of the goods, and forced him to write checks in the name of the first company, and others for the bearer, and they were not satisfied with that, but rather insisted that he accompany them to the place of the person who sold him the goods, and when he tried to inform the police on the way , one of them beat him, then they stopped the vehicle in a sandy area, and one of them called his wife, and told her that her husband had been kidnapped, and he would be killed if she did not bring the money immediately. He pays 220,000 dirhams, and after negotiating with the brother-in-law, they agreed to accept two checks for the amount.

The defendants denied the charges against them before the Court of Appeal, and their defense insisted on the maliciousness of the accusation, based on the fact that the victim reported the incident three days after its occurrence, but the court was assured of the evidence, and decided to support the first degree verdict, imprisoning the defendants for three years, and fining them jointly 320 thousand dirhams, and banish them from the state.
