The neighbors hear his screams all the time

In the ruling's rationale, the court said that the accusation against the wife was not established in her right, in addition to the absence of certain evidence to convince the court.

In detail, the son of the victim submitted a report through the application of the Public Prosecution, stating that his father was assaulted and mistreated by his wife at their residence. Immediately, the Public Prosecution took permission to enter the house, and it was entered, and the victim was transferred by the National Ambulance to Hospital, direct medical care.

The medical examination revealed that the 86-year-old victim was brought by the National Ambulance, claiming that he had been assaulted, and that he had a slight abrasion on the skin in the right leg, and pain in the right hand. He was thoroughly examined through a CT scan, and he was discharged from the hospital, and handed over to his wife. The defendant is entitled to their home.

The complainant admitted that he wanted to investigate neglect and abuse, and his father was subjected to psychological and physical abuse at the hands of his wife, as he was informed by neighbors who live near his father’s house that they heard his screams, as if he was seeking help from someone who assaulted him, indicating that the last time he was able From seeing his father was about a year ago.

For his part, the witness, who works at the police station, said in the investigations of the Public Prosecution, that on the day of the incident, he moved to the victim’s house, because there was a report of assault, and based on the entry permit issued by the Public Prosecution, he and a group of individuals moved, and when they arrived at the house, they knocked The bell rang more than once, and after five minutes, the accused opened the door, and they entered the house, confirming that the victim was in an unair-conditioned room, lying on the floor, covered with a blanket.

The witness added that the victim was pointing with his bruised hand, and when asked, he said that the accused beat him with a wooden stick on a daily basis, and that he was thirsty and wanted water, pointing out that the victim was given approximately three cups of water, then the national ambulance was requested, and he was transferred He was taken to the hospital, and later it was found that he had an injury to his hand, pointing out that it was widespread among the neighbors that the accused beat him and punished him continuously, because they heard his screaming continuously and repeatedly.

By questioning the accused in the minutes of inference and investigations of the Public Prosecution, she denied the charges against her, as she stated that she did not assault her husband by beating, and did not prevent his children from seeing their father, except that he did not want to see them, stressing that the victim sleeps on the bed, except that he falls from Above him while sleeping, which made him ask her to sleep on the floor, as she shuts off the air conditioning continuously, due to his constant request to do so, because he feels cold.

She stated that he screamed repeatedly, and imagined seeing people in front of him, due to his old age, and accordingly, the accused was sponsored, and initial measures were taken, and the case papers were referred for disposal.

The lawyer, Amna Al Darmaki, submitted a defense memorandum, requesting the innocence of her client, given the maliciousness and fabrication of the communication, and the absence of evidence of the charges against her in the case papers.

In addition, the court acknowledged the innocence of the accused of the charges against her, given that the accusation against her is not established against her, in addition to the fact that the papers are devoid of convincing evidence to convince the court, and is considered an argument in proving the accusation, noting that all those who were questioned said that they heard and told them The complaint may be considered hearing only, and from persons other than the victim, who did not file a complaint against the accused.

The court stated that the victim's handing over of the accused after his discharge from the hospital, despite the two accusations being brought against her, does not prove anything against her, which casts doubt on the validity of the accusation.

• The victim was found to have a minor abrasion on the skin and was taken out of the hospital and handed over to his wife.
