The dispute between the communities and the Government to toughen the measures to face the pandemic is experiencing a new chapter, already jumping into the judicial sphere.

Castilla y León decided yesterday to impose a curfew in its community at 8:00 p.m., an hour that was not endorsed by Health, based on the fact that the decree allows a fan from 10 p.m. to 7 a.m.

The new schedule started yesterday in this region.

The Government has decided to take this measure to court to prevent it.

The Government has requested the

General State Attorney

to file a contentious-administrative appeal before the Administrative Litigation Chamber of the

Supreme Court

against the agreement of the president of the Junta de Castilla y León (as delegated competent authority), by which they are determined the start and end times of the limitation of the freedom of movement of people at night.

Faced with the increase in infections and deaths, several communities have requested the Ministry of Health to grant them legal tools to be able to confine - modifying the state of alarm decree - or, at least, advance the curfew - which would also require a modification of the text-.

The refusals offered by Minister Salvador Illa led Castilla y León to take the initiative and, despite Illa's rejection, set the curfew at 8:00 p.m., a kind of rebellion that had the endorsement of the PP.

In fact, despite the fact that Health did not validate this advance, the Government Delegation in the Castilian-Leon community did mobilize the National Police yesterday to supervise compliance with this new curfew, which in the autonomous government was interpreted as an endorsement of your size.
