The details of the case relate to the plaintiff’s request to oblige the defendant to pay him 100,000 dirhams in compensation for the financial and moral damages that he suffered as a result of a false report filed by a woman against him, in which he claimed that he assaulted her body.
After investigating the incident, the Public Prosecution ordered to preserve the communication, but this report inflicted material and moral damages to him as a result of delaying his promotion to a higher position, which would have led to his obtaining large sums of money and improving his income, and that was due to his inability to travel to perform special tasks As a result of seizing his passport and preventing him from traveling, in addition to his absence from work during the investigation period.
He pointed out that the false report caused harm to his reputation among his colleagues, family and relatives, which caused him sadness and anxiety, and the plaintiff submitted a scan of documents, including a misdemeanor preservation order issued by the family prosecutor in Abu Dhabi, while the plaintiff submitted memoranda in which she ended up requesting the ruling to reject the case.
The Abu Dhabi Court of First Instance stated that it was proven from the papers that the defendant had submitted a complaint against the plaintiff to the competent authorities accusing him of violating and threatening her integrity, and the Public Prosecution ordered the preservation of the misdemeanor due to insufficient evidence, and no grievance was made about that.
The court clarified that what is proven from the records of the preservation order is that the accusations that the defendant brought against the plaintiff is not evidence of it, which is achieved with the element of error in the compensation lawsuit for false reporting, which is the minimum in issuing the notification of haste, recklessness and lack of precaution, noting that the defendant’s mistake She must be steadfast, and it also caused harm to the plaintiff’s reputation among his colleagues, family and relatives, which makes the request for compensation for these damages based on reality and the law and is acceptable, and the court ruled obligating the defendant to pay the plaintiff an amount of 30,000 dirhams and the expenses, and it rejected what increased On that of requests.
