The Human Resources Authority has issued the executive regulations of the Human Resources Law in the Emirate of Abu Dhabi, after its approval by the Executive Council.

The new regulation included a number of updates to its items, to become more comprehensive and flexible, in line with the developments and modern administrative changes, and in line with the goals of the Abu Dhabi government and international best practices.

Among the most prominent updates are the identification of three types of "promotions", granting two hours of departure for female employees born in Ramadan, and opening the door for appointments for military and civilian retirees.

The regulation - which came into effect on the fifth of April this year - aims to push towards enabling government agencies to manage their human resources affairs independently and with broad powers, and contribute to the development of their human resources, and enhance the principle of productivity and innovation, in order to enhance the level of motivation and raise the efficiency of performance and support job stability In the system of government work in the emirate.

The authority pointed to the great efforts made by the work team in order to cover the list of all technical and legal items, and to maintain building a stimulating and competitive work environment that achieves justice and job security for both parties in the work relationship. Including that the types of work are defined, which are the official working hours, and the head of the government agency may apply the flexible working hours, as well as the shifts and remote work system, and is outside the employee's workplace, and the employee enjoys all the rights and privileges stipulated in the law and its executive regulations.

The regulation also allows part-time appointment of citizens, and the employee is entitled to 50% of the total salary of the position assigned to it, and he is also entitled to obtain the leave and other allowances stipulated in the regulation, in order to encourage the owners of small and medium enterprises to practice private work, in a manner that does not prejudice the tasks The position assigned to the employee in his work in the government agency.

The regulation stipulated a provision for overtime, which allowed the head of the government agency to assign the employee to work after working hours and public holidays. The employee is guaranteed compensation for days equal to work days during the holidays, and the employee is also entitled to a compensation for his work overtime after the official working hours.

During the development of the provisions of the executive regulations, the commission has been keen on enabling and integrating people of determination (with disabilities) in the governmental work system, and giving them special attention so that career opportunities are available to them like the other categories mentioned in the list, in coordination and cooperation with the Department of Community Development.

The regulation approved the appointment of a retired military and a civilian, with a minimum age of 60 years upon appointment.

The military retired person shall be appointed according to the bonus system specified by a decision of the Executive Council in this regard.

As for the civil pensioner, he is appointed with the pension suspended, and he gets the gross salary for the position he is appointed to, and the pension will be returned to him if the salary is lost.

The regulation also stipulated that the employee who joined the national service as if he was at work, gets all dues and benefits, and receives a performance evaluation that is not less than very good, unless the national and reserve service authority decides otherwise based on his performance during the service.

The authority pointed out that the opportunities for promotions and career progression are better and greater in the executive regulations issued for the Human Resources Law, and are linked to excellence in performance, skills and competencies, and are not in any way a binding entitlement to the government agency towards its employees, where the system of promotions includes three types of promotions, namely: Sub-promotion, job promotion and employee financial promotion in the absence of a vacant position.

The regulation also stipulated that all types of leave be mentioned, including but not limited to, such as the employee’s right to maternity leave for a full three months, and her right to obtain two hours of leave per day, for a year from the date of delivery. It also deserves it in the holy month of Ramadan, periodic leave, full-time leave for volunteer work, and representation of the state in international partnerships.

For employees of determination, the list included granting them five working days in addition to their periodic (annual) leave they deserve, in support of them to complete their special transactions.

The regulation pointed out that the government agency may grant the employee a paid study leave after coordination with the Education and Knowledge Department, as well as a patient accompanying leave inside or outside the country, according to the regulations set forth in the regulations, and for a period of three months with paid salary per year, and the employee may request to extend a patient accompanying leave Without a salary, the employee also deserves sick leave based on an approved medical report, and the employee's hours may be reduced for health reasons based on the recommendation of the Medical Committee.

The executive regulations determined the types of administrative measures, which may be directed to the employee in minor violations committed by the employee, before the administration resorted to imposing disciplinary sanctions, as well as the types of violations and the limits of penalties when the employee violated the duties and rules of employment behavior, and also stressed the need for each government agency to form a committee called The complaints and grievances committee, which specializes in looking into employee complaints and grievances, and submitting its recommendations to the head of the government agency.

Appointment of people of determination

The executive regulations of the Human Resources Law stipulated that the government agency is obligated to appoint citizens of concern with the percentage determined by the commission from the total number of approved jobs.
