Citizens told «Emirates Today» that they prefer to return to their jobs from which they were arbitrarily separated than to be compensated by three months' salaries, according to the law, requesting the concerned authorities to enact a law that requires private establishments that have been found not to have the right to dismiss the citizen employee to return to his job again, and this requires the Ministry Human resources and resettlement intensify their inspection and observation of the environment in which citizens work before considering complaints of termination of their services.

And Resolution (212) concerning the work of citizens in the private sector has permitted, after the end of service of the employee (citizen), for the Ministry to take one or two measures, and that is to return the citizen after completing his services to the record of job seekers, and he shall have priority in the appointment in a manner that suits With his qualifications, experience and ending conditions of service.

In detail, citizen Ahmed Saif demanded that the ministry study and monitor the work environment, before deciding on complaints that companies receive to the ministry against one of its citizens employees, to find out the reasons that prompted the employee to commit what he did, and required the application of the law.

He continued: "We hope the Ministry of Human Resources and Emiratisation will change its strategy regarding the Emiratization file," explaining that Emiratization is not only providing jobs for citizens, but the matter needs to be studied in all aspects, whether the work environment, career development, job security, or motivation from Before the employer, in order for the citizen employee to continue in his workplace, the Ministry must take the necessary legal measures to return the citizen to his work if it is proven that the termination of his services was arbitrary.

Citizen Arwa Al-Naimi said that she and six female employee employees were fired from their work in a bank branch in Al Ain, two days before completing six months at work.

She added that the branch administration notified them that the branch would be closed, adding: "The administration kept non-Emirati employees and offered them to move to another branch of the bank, so they agreed, but they did not offer us that."

The citizen Saif Al-Naimi stated that there is no law requiring the employer to return the citizen to his previous job, if it is proven that the termination of his services is due to an unlawful reason, and with the issue being transferred to the judiciary, the employee will be compensated only with three-month salaries.

He added that the employee whose services are terminated has difficulty obtaining another job, because he is not resigned, as some agencies refuse to employ him for fear that he has precedents, and therefore there is no job security for the employee in the private sector, and therefore a firm decision must be applied that is required not to be arbitrarily terminated.

For his part, Lawyer Rashid Al-Suwaidi demanded the enactment of a new law that preserves the citizen’s right in the event of arbitrary dismissal, the payment of a salary to someone who lost his job arbitrarily until he joined another job, and employing the citizen if he lost his job arbitrarily and did not find another job after seeking.

The law allowed the employer to fire the employee without prior notice in 10 cases, if the worker impersonated a false identity or nationality, or provided false certificates or documents, and if he was appointed under trial and the dismissal occurred during the trial period or at the end of the trial, and if he committed a mistake, a loss resulted Material material to the employer, provided that the Ministry is informed of the accident within 48 hours, from the time the (the employer) learned of its occurrence.

Among the cases of dismissal without notice, if the employee violated the instructions for work safety, or the place of work provided that these instructions are written and suspended in a visible place, and if the employee did not perform his basic duties, according to the labor contract, and he continues to violate them, despite a written investigation conducted with him For this reason, he should be warned about the dismissal from the employer, if it is repeated from that, and if it is proven that he disclosed a secret of the establishment in which he works.

The employee may also be dismissed without notice, if he is finally ruled by the competent court for an honorable crime or breach of trust or public morals, and if during the working hours he is found to be very drunk or affected by an anesthetic, and if during the work he is attacked by the employer, manager or manager The official or one of his co-workers, and if he absent without legitimate cause more than 20 intermittent days during the contractual year or more than seven consecutive days.

On the other hand, «Emirates Today» contacted the Ministry of Human Resources and Emiratisation to clarify complaints of citizens employees arbitrarily dismissed from their jobs, especially before the end of the first six months of work, and their request for a law that protects them from arbitrary dismissal, and another law that requires establishments that prove that they have ended services An arbitrary citizen returned him to work again, but it was not possible to obtain a response from the Ministry on these complaints.

Illegal reason
