by Tiziana Di Giovannandrea 29 April 2019The Agcm, the Italian Antitrust Authority, has fined the telephone companies Vodafone, Wind and Fastweb.

The fines sprayed by the Antitrust Authority against Vodafone and Wind amount to 800 thousand euros each, while the fine is 600 thousand against Fastweb. The penalties were deliberated for not having allowed customers to pay fixed and mobile telephony services through bank domiciliation on current accounts opened with Banks based in European Union countries other than Italy and therefore with Iban not characterized by the initials national "IT".

At the same time, the Antitrust Authority prohibited companies from continuing with this conduct.

In particular, the origin of this "Iban discrimination" is the choice by the companies of the Seda payment system, an optional and additional service (AOS) compared to the European Sepa payment system, mainly used by Italian banks.

No penalty, on the other hand, for Telecom Italia SpA, of which the Antitrust Authority has accepted, making them mandatory, the commitments undertaken by the company on the basis of the Consumer Code and which the company must immediately implement. Telecom within sixty days from the date of notification of the resolution must inform the Antitrust Authority of the implementation of the commitments made.

The procedure can be re-opened automatically if the commitments are not respected; if the situation is changed with respect to one or more elements on which the decision was based; if the decision to accept commitments is based on information submitted by the parties that is incomplete, inaccurate or misleading.
