The reason was his interview to the Austrian Catholic portal kath.net of July 2017 on the occasion of the adoption of the law “marriage for all” in Germany, which gave same-sex couples the right to register their relationship. The 64-year-old scientist stated the following: “If the right to adoption for male and female same-sex marriage unions comes into force, then we are waiting for state-supported pedophilia and child abuse.”

Along with this, the defense of Kučera provided the court with 14 petitions, which were compiled by renowned professors and pediatricians, confirming the validity of his statements from a scientific point of view. Thus, these words can not be considered by the court as inciting hatred.

According to the scientist, the headlines of the German press about his supposedly deliberate insult of members of sexual minorities are taken out of context. He perceives them as "personal insult and slander."

“I have cooperation projects with gay biologists at home and abroad, and I am by no means“ homophobic, ”Kucera added.

After wide coverage of this trial in the German press, he stated that he did not want to offend members of sexual minorities and regretted choosing too “radical wording”.

“In the future, I will speak more diplomatically,” explained Kucera.

It is noted that the court has not yet made a decision on the case. A new hearing should be scheduled soon.

The law on the legalization of same-sex marriage was adopted by the German Bundestag on June 30, 2017. It entered into force in Germany on October 1 of the same year. The first who registered the marriage were men 59 and 60 years old. The event took place in the town hall of one of the administrative districts of Berlin.
