In his capacity as Ruler of Dubai, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE, issued Law No. (2) of 2019 amending some provisions of Law No. (21) for the year 2015 concerning judicial fees in Dubai courts. In accordance with the amended article 8, some categories, suits, appeals and appeals shall not be subject to the prescribed design: suits, appeals or motions submitted by the federal or local government authorities in the Emirate or any of the emirates of the State, as well as cases related to endowments, donations and wills, Charity if such claims are filed by such parties.

The new law, in its first article, replaced the provisions of Articles (8), (14) and (35) of the original law with other provisions relating to non-payment of fees and the estimated value of the case, in addition to the relative fees for implementation.

The claims submitted by the shareholders shall not be subject to the right of the board of directors of the public shareholding company or its executive management, where the percentage of the contribution of the plaintiffs shall not exceed 10% of the total shares of the company, in addition to the appeal of the provisions of alimony, On the pretext of bankruptcy, and bidders of the price of the property, and deposited by federal and local government bodies to the concerned parties. Applications for publicity or proof of Islam, ratification of a social welfare application, and requests for death and heredity are not subject to the fee.

In accordance with the amended Article (14), claims filed before the courts of first instance, civil suits of the criminal case and claims arising out of business in excess of AED 500,000, excluding personal status cases, shall be charged a fee of (6%) of the value of the case, The amount of this fee is 500 dirhams, not more than 20 thousand dirhams if the value of the lawsuit does not exceed 500 thousand dirhams, and 30 thousand dirhams if the value of the lawsuit ranged between 500 thousand and one thousand dirhams to one million dirhams, and 40 thousand dirhams if the value of the lawsuit exceeds Million dirhams.

The same article stipulates that the lawsuits arising from business brought before the courts of first instance, which are worth 500 thousand dirhams or less, shall be charged at the rate of 6% of the value of the case, provided that the amount of this fee shall not be less than 500 dirhams and not more than 20,000 dirhams (6%) of the value of the case, provided that the amount of this fee shall not be less than 500 dirhams and not more than 5000 dirhams. This fee shall be added to the expenses of the case being adjudicated.

Suits arising from business

Article (35) of the Amended Law stipulates that the execution of executive bonds, except for the executive bonds issued in cases arising out of business not exceeding 500,000 dirhams, shall be met by a fee of (2%) of the value for which execution is required.
