Article 102 of the Algerian Constitution states that if the President of the Republic is unable to exercise his functions due to a serious and chronic illness, the Constitutional Council shall meet and, after ascertaining the truth of this impediment by all appropriate means, shall unanimously propose to Parliament the authorization of the obstruction.

The Parliament shall announce in a joint session of its chambers the provenness of the impediment to the President of the Republic by a two-thirds majority of its members. The President shall be charged with acting for a maximum period of 45 days as Speaker of the National Assembly, in this case Abdul Qader bin Saleh.

If the impediment continues after 45 days, the vacancy of the post of President of the Republic shall be announced by resignation. In the event of the resignation or death of the President, the Constitutional Council shall meet and decide on the final vacancy of the Presidency.

The certificate of final vacancy shall be immediately communicated to the Parliament, which meets in Juba. The President of the Council of Nation shall assume the functions of Head of State for a maximum period of 90 days, during which presidential elections shall be organized.

The Head of State appointed in this manner shall not be entitled to run for president.
