As Koreans living in Japan got involved in the returning business to North Korea, as a result of not being able to enjoy fundamental human rights for many years, they escaped from North Korea and returned to Japan after being forced to live a miserable life. Five North Korean people took action against the North Korean government on 20th, causing the Tokyo District Court to file a lawsuit seeking damages totaling 500 million yen.

Elegant Eiko Kawasaki, 76, who lives in Tokyo, sued five people from 57 to 77 who passed North Korea in the 1960s and 70s and defeated in the 2000s.

The plaintiffs said that although North Korea cheated Koreans in Japan as a "paradise on the earth" to participate in the returning business, they did not give adequate food in the country, and criticized that they refuse to resist and leave the country as basic Arguing that suppressed human rights. "The returning business is an act of national abduction by North Korea."

It is unusual for North Korean defectors to appeal to the North Korean government, but before substantive trials, whether Japan's jurisdiction extends to foreign governments, whether prescription is not established, etc., is likely to be a problem first. The plaintiffs argue that the damage still continues, "Family members left in North Korea are not allowed to depart and can not be reunited."

In February 2002, the United Nations North Korea Human Rights Investigation Committee announced a report to recognize the infringement of human rights abuses of North Korea including the Japanese abductions and returning business as "a crime against humanity". The plaintiffs filed for human rights relief to the Japan Federation of Bar Associations (JFBA) for 15 years, over the return business against Japan and North Korea governments and the Korean Federation of Koreans (Korea Federation). In February this year, Mr. Kawasaki has submitted a petition to investigate the punishment of Kim Jong-en, chairperson of the Korean Workers' Party, and others, to the International Criminal Court (ICC) prosecutor of The Hague, The Netherlands.
