The Ministry of Human Resources and Emiratisation - in response to questions from a number of visitors to its Facebook page - confirmed the worker's right to obtain a new work permit in the country, without requiring the consent of his sponsor to terminate the working relationship between them, according to four legal cases. The second is the existence of a complaint filed by the worker against the establishment in which he works because he is not attached to the work to close the establishment. The report stipulates that the inspection sector in the ministry proves that the establishment has not been active for more than two months. As for the third case, the ministry reported that the worker may also obtain a new work permit without the consent of his first employer to resign if the labor dispute can not be ended amicably and the worker's complaint is referred to the court. At least two months, compensation for arbitrary dismissal, termination of the contract specified before termination, or any other rights not given by the employer to the worker, provided that the provision does not include a provision to leave the worker on his own without a reason recognized by law or to deprive him of termination indemnity.

The ministry explained that the resignation comes in order to inform the employer of the desire to terminate the employment relationship, but the worker must prove his notification of resignation, either by obtaining his signature on the letter of resignation or sent to him by fax or mail. If he resigns without completing the term of his contract (if his contract is fixed-term), he shall be subject to deprivation of employment in the State for one year. If his contract is unlimited, he must warn the employer and continue his work during the agreed warning period.

The fourth case was that the employer had voluntarily terminated or not renewed the employment relationship and had not submitted a resignation from the worker, stressing that the new work permit would be revoked if it was found that the data on which it had been given was incorrect.

The ministry confirmed that it is permissible to grant a new work permit to the worker after the end of his employment relationship with the employer, to move from one establishment to another without restricting six months from the date on which the work card was canceled, noting that there are two conditions for the worker to resign for a new work permit And the second is that he has spent at least two years with the employer, which excludes the worker whose new job is at the technical levels (I, II or III) provided that his new salary is not less than AED 12,000 at the level First skill, AED 7000 in second skill level, and 5,000 AED at the third skill level.

The worker shall be exempted from the requirement of working two years before the resignation, in the event that the employer breaches his obligations towards him or when he is not a reason to terminate the employment relationship or if the transfer is to another establishment owned or shared by the employer in which he worked.
