Guangxi 10-year-old "Passion Fruit" girl was murdered in court for retrial, prosecutor proposes to commute the death sentence

  Beijing News (Reporter Wang Wei) On the morning of the 15th, the retrial of the "passion fruit girl" murder case in Guangxi opened.

In court, the prosecution recommended that the murderer be sentenced to death.

Previously, the defendant Yang Guangyi, who killed a 10-year-old girl, was sentenced to death in the first instance for intentional homicide, and was sentenced to death with a suspended death sentence for surrendering in the second instance.

After that, the Supreme People's Court reviewed the case and ordered the Guangxi Higher Court to re-examine the case.

  At 9 o'clock on the 15th, the case was heard in the Guangxi High Court. The mother and uncle of the murdered girl Yang Xiaoyan arrived at the court, but left the court halfway due to emotions.

"There is evidence that he (Yang Guangyi) molested other girls, and if not sentenced to death, he would harm many people." Ms. Chen, the mother of the "Passion Fruit" girl, said in an interview.

  According to the official report of the Guangxi Higher People's Court, the court today opened a trial in accordance with the trial supervision procedure on the rape of Yang Guangyi.

The People's Procuratorate of the Autonomous Region sends officers to appear in court to perform their duties.

  The court informed that during the trial, the complainant and his lawyer appeared in court to express opinions.

Yang Guangyi and his defenders expressed their defense opinions based on the crime facts, evidence and the circumstances of the crime.

Due to the privacy of the victim, the hearing was held in private.

  Hou Shichao, a lawyer representing the victim’s family, said that the case mainly revolved around the crime, the number of crimes, whether the death penalty should be imposed (immediate execution), whether surrender can be lightened, and whether psychiatric evaluation is necessary.

In court, the prosecution recommended that Yang Guangyi be sentenced to death.

  After the court hearing, the sentence will be announced at an optional time.

  The Beijing News previously reported that a 10-year-old girl in Lingshan, Guangxi, disappeared while selling passion fruit. The man, Yang Guangyi, was sentenced to death by the court in the first instance on July 12, 2019 for rape. He killed him and took away the 32 yuan from selling passion fruit from the girl.

  On April 7, 2020, the second instance of Guangxi Higher People's Court changed his sentence of "death sentence with a two-year suspension of execution" on the grounds that Yang Guangyi had surrendered.

According to the judgment, the Guangxi High Court held that “the facts of the case ascertained by the court of first instance were clear, the evidence was indeed sufficient, the conviction was accurate, and the application of the law was correct”. However, the sentence was improperly sent because it did not take into account the circumstances of Yang Guangyi's surrender.

  The result of the revised judgment of the case sparked heated debate. On May 10, the Supreme Court decided to review the final judgment of the case. On May 11, the girl’s family filed a complaint with the Guangxi Higher Court. On November 11, 2020, the Supreme People's Court ordered the Guangxi Higher People's Court to form a separate collegiate panel to retrial the Passion Fruit Girl murder case after reviewing the files.
