The "Zhang Zhichao case" co-author Wang Guangchao applied for state compensation of 3.07 million and was accused of sheltering and being detained

More than half a month after Zhang Zhichao, a party in the "Linshu No. 2 rape and murder case" in Shandong, filed an application for state compensation with the court, his fellow criminal Wang Guangchao also filed an application for state compensation with the court recently. On June 18, the cover news reporter learned from Wang Guangchao’s attorneys, Liu Zhimin and Wang Chaoyong, that day, the lawyer had mailed a state compensation application to the Linyi Intermediate People’s Court in Shandong Province and applied for a total of more than 3.07 million yuan in state compensation.
It is understood that Wang Guangchao should have filed a national compensation application with the lawyer on the 15th at the Linyi Intermediate Court. Due to changes in the Beijing epidemic situation, after communicating with the court, the lawyer instead submitted the national compensation application to the court by mail.
Wang Zhichao is the same case in the “Zhang Zhichao Case” in Shandong, which has attracted widespread social attention. In January 2005, a high school girl from Linshu No. 2 Middle School disappeared. One month later, the body was found in an abandoned toilet in the school. The next day, Zhang Zhichao, a 15-year-old high school student, was taken away from his home by the police. On the same day, Zhang Zhichao's friend Wang Guangchao was also taken away by the police.
The verdict in the first instance of the case found that Zhang Zhichao violated the girl on the day of her disappearance, and Wang Guangchao, as an insider, deliberately made false testimony and shielded him. In March 2006, the Linyi Intermediate People's Court found Zhang Zhichao's rape was convicted and sentenced to life imprisonment. Wang Guangchao was accused of assault and sentenced to three years’ imprisonment with a three-year suspended sentence. After the verdict in the first instance, neither of them appealed.
Wang Guangchao recalled to the cover news reporter that he and Zhang Zhichao were both classmates and friends. During his first year of high school, Zhang Zhichao was the class leader. He was a sports committee member. Later, he was divided into liberal arts classes. Zhang Zhichao studied liberal arts and Wang Guangchao studied science. During the police investigation, Wang Guangchao was once released on bail pending trial, but was re-incarcerated because of confessions, and was sentenced to 13 months in custody until the first trial.
Wang Guangchao said that in the criminal police team, he was forced to make a guilty confession. He once thought he was involved in the case because Zhang Zhichao "bited him". Although it happened many years later, every time he saw a TV report about an injustice, he would think of his own affairs.
On December 28, 2017, the Supreme People's Court made a retrial decision, arguing that the facts of the case were unclear and that there was a contradiction between the main evidences, and instructed the Shandong High Court to form a collegial panel for retrial. On January 13, 2020, Shandong High Court retriald Zhang Zhichao and Wang Guangchao innocent. On May 25, the "Zhang Zhichao Case" was also selected into the work report of the Supreme People's Court and the Supreme People's Procuratorate.
The reporter learned that Wang Guangchao had five national compensation applications, including personal liberty compensation, mental damage relief, loss of lost working hours, rights protection and transportation costs, and public apology for compensation in the media. Among them, Wang Guangchao was detained for 390 days after the lawyer calculated that Wang Guangchao was detained for 390 days. According to the latest national compensation standard, 346.75 yuan per day was applied for a total of 13,5232.5 yuan.
In the part of the mental damage relief fund, Wang Guangchao applied for compensation of 2 million yuan from the court. His lawyer said that in 2005 Wang Guangchao was still a high school student who had just turned 16 years old. After the court sentenced him, he became a guilty person and was laughed at in the village, and his parents could not lift his head in the village. After that, Wang Guangchao's education was terminated, and he couldn't find a job in his hometown, so he had to leave his hometown to find a job. However, many companies have requirements that prohibit criminal punishment. The wrong sentence was a huge disaster for Wang Guangchao and the whole family.
In an interview with cover news, Wang Guangchao said that his grades in secondary school were fair, especially in the physical and chemical subjects, and he also took the first place in the physics exam in the first grade of high school. But after being detained for more than a year and sentenced, he has no intention of continuing to study and has to work outside. This case has changed his life path.
Lawyer Liu Zhimin believes that Wang Guangchao was convicted and lost the opportunity to receive a good education, resulting in a loss of work remuneration caused by his low professional skills should be an inevitable benefit, and the people’s court should include it in the scope of state compensation. The expenses such as transportation expenses and accommodation fees paid by the claimant for many years are obviously inevitable expenses and should be calculated based on direct economic losses. Expenses such as lost time costs are also a loss of vested interests and should be compensated. Therefore, in addition to personal liberty compensation and mental damage relief, Wang Guangchao also applied to the court for a loss of 840,000 yuan in lost time costs and 100,000 yuan in rights protection transportation costs.
The cover news previously reported that on June 1, Zhang Zhichao submitted a state compensation application to the Linyi Intermediate People's Court through a lawyer, and applied for a total of more than 7.8 million yuan in state compensation, including more than 1.8 million yuan in personal compensation and 6 million yuan in mental damages. At present, Linyi Intermediate People's Court has filed a national compensation case for Zhang Zhichao.
