The Government has reached a principle in agreement with the social partners in the framework of the social dialogue to lengthen the temporary employment regulation (ERTE) files, sources close to the negotiation have confirmed to Europa Press.

However, the text will have to be ratified by the different trade union and business organizations. Thus, CEOE has called its Executive Committee to a meeting at 9.00 this Friday .

On the union side, the UGT will also hold a Confederal Committee to give its approval to the draft, as will the CCOO that will bring together its Executive.

If the management bodies of the social partners give the go-ahead to the agreement, it is not ruled out that the measure was approved by the extraordinary Council of Ministers that is being held this Friday to give the green light to the extension of the state of alarm.

Government and social partners have reached this principle of agreement after a marathon meeting, which started after noon and forced the meeting that unions and businessmen had planned to hold at 8:00 pm yesterday, Thursday, to continue talking about the de-escalation.

The objective of this negotiation on the ERTE was to ensure that, after the state of alarm, those sectors that need to maintain the ERTE can do so to safeguard employment and avoid business closings, and that those who are recovering can reincorporate workers included in these procedures. progressively.

The regulation that the Government established with the health crisis facilitated the presentation of ERTE due to force majeure and for economic, organizational, technical and production reasons. Social Security reported last Tuesday that 3.38 million employees were included in ERTE .

In addition, this regulation that was given to the ERTE due to force majeure derived from the Covid-19 establishes a series of benefits: exemption from contributions of 75% for companies that as of February 29 of this year had more than 50 workers registered in the Social Security and 100% for those with less than 100 workers.

Workers affected by ERTE receive unemployment benefit even if they do not meet the minimum contribution period . These extraordinary measures are subject to the company's commitment to maintain employment for a period of six months from the date of resumption of activity.

Precisely, this has been one of the workhorses of the negotiation. The CEOE had warned that this clause could lead to the massive closure of companies if they were forced to keep the workforce for half a year without having regained activity.

It remains to be seen how that point will finally be in the agreement, if the quota exemptions for companies will be maintained (or for how long at least) and if the restrictions on objective dismissals that have been established during the state of alarm are lengthened over time, as entrepreneurs don't like anything.
