The student council president-elect of a high school in Chungju, North Chungcheong Province was disqualified from the election after it was revealed that he had committed unfair acts during the election process.



Yesterday (26th), the 13th Civil Division (Judge Lee Hyo-doo) of the Cheongju District Court filed a lawsuit against the Chungbuk Office of Education and won when it was not accepted after claiming the unfair behavior of the opponent candidate in the high school student council president election on July 15th.



At that time, the school's election management committee (hereafter referred to as the National Election Commission) announced the winner as the student with the highest number of votes.



As a result, the candidate for the number 2 claim to invalidate the election for the reason that there was an unfair act on the side of the symbol number 1 during the election process, but the school elections committee did not acknowledge it.



Previously, on July 7, the candidate for Vice President No. 1 Kiho said to a first-year student, "I will buy you a hamburger if you help me with the election campaign," but was warned by the school elections committee.



Afterwards, the 1st election campaign helper also posted a slanderous article on social media to the candidate for vice-president No. 2, saying, "I don't want to look at you."



However, the school side judged that it was not a reason for warning and protested that it was only a warning, and treated it as a simple school violence case.



In the end, candidate No. 2 filed a lawsuit against the Chungbuk Office of Education, saying, "The school and the school election management committee condoned the unfair election campaign on the part of the elected student."

The court judged that the above act was an act that affected the election, and that the school elections committee should give a warning, seeing that it was a reason for invalidating candidate registration.



At the same time, “The school election commission violated the election regulations regarding election management in this case, and if this regulation was followed, the candidates for symbol number 1 would have accumulated more than two warnings and lost their candidate qualifications due to invalidation of candidate registration and could not have been elected.” explained.



According to Article 17 of the relevant school election regulations, 'reason for invalidation of candidate registration or reason for warning', the act of giving food or gifts to voters and the act of slandering other candidates are all grounds for warning.

In addition, it is stipulated that if two or more warnings are accumulated, candidate registration will be invalidated.



The judge said, "The election commission can be seen as significantly infringing on the basic ideology of elections, the freedom and fairness of elections, and influencing the results of the elections."



He added, “Compliance with election regulations can be an educational purpose in that students who participated in the election of school student council officers already have the right to vote in public office elections, or soon have the right to vote.”



Regarding this, the school said, "The student president election is part of educational activities, and it is not an issue that will go to trial." .
