The bereaved family insisted that former mayor Park could not be seen as the perpetrator, but the court did not accept that.

After the investigation was suspended due to former Mayor Park Won-soon's extreme choice in July of last year, the victim's side requested an ex officio investigation into former Mayor Park's actions to the National Human Rights Commission.



In January of last year, the Human Rights Commission judged this as sexual harassment, saying that "Mayor Park sent inappropriate messages and photos late at night and touched her nail art nails" as fact.



The bereaved family of Mayor Park filed a lawsuit to cancel the Human Rights Commission's decision, claiming that the Human Rights Commission only accepted the victim's claim.



After a year and seven months of hearing, the court of first instance concluded that the Human Rights Commission's judgment was valid.



The bereaved family argued that, judging from the intimate text message conversation between the two, Mayor Park could not be seen as the perpetrator, but the court judged that these actions "seem to be a passive expression to avoid sexual behavior that is difficult to answer and end the conversation." I did.



In addition, "The plaintiff's argument is that victims of sexual harassment in the workplace should immediately become dark and helpless when they see the damage," which was an arbitrary thought that overlooked various aspects of the victim.
