A parent filed an administrative lawsuit stating that a student with a disability cannot intentionally sexually molest a student with a disability when two high school teachers reported a student with a disability and a special education disposition was issued.



Today (27th), according to the Gyeonggi Provincial Office of Education, etc., two teachers from a high school in Gyeonggi Province said that on October 7, 2020, group A felt sexual shame by touching the chest area while receiving a temperature check while attending school. He claimed to have pinched his arms or touched his chest on several occasions.



As a result, group A received a disciplinary action equivalent to five days of suspension of attendance, but avoided disciplinary action as the committee was invalidated by the administrative judgment of the Provincial Office of Education that the school did not properly follow the procedures related to the school rights protection committee.



Then, the school supplemented the related procedures and opened a committee again, and in the end, group A received special education for 4 days of psychotherapy.

Parent B protested against this and filed an administrative lawsuit against the school in January to the effect of 'to cancel the special education disposition given to group A'.



Mr. B claimed that group A has autism spectrum disorder and can suddenly stretch his arms, but his intelligence is only at the level of 3-4 years old, so he cannot intentionally commit sexual harassment or violence.



In the meantime, he claimed that there are records of school life without violence in Group A's notice, and there are eyewitness statements that Group A never touched the breasts of two teachers.



In addition, Mr. B said, "It is unacceptable to dispose of my son on the basis of sexual harassment in a situation where the truth of the case has not been fully identified."



In this regard, a school official said, "Our school is in a neutral position in disputes between teachers and students."
