Two young men who had appealed in cassation were definitively condemned this Wednesday to 18 years of imprisonment.

They were accused of attempted murder of police officers in 2016 in Viry-Châtillon in Essonne.

In April 2021, the closed appeal trial of this case had taken place and the Paris minors' assize court declared five defendants out of the thirteen guilty of attempted murder of police officers.

The court was judging the facts of October 8, 2016 when 16 people attacked in broad daylight, some with Molotov cocktails, two police cars parked near the Grande Borne district (Essonne).

Of the four officers, a 28-year-old security assistant and a 39-year-old peacekeeper had caught fire.

“Legally applied penalties”

The highest French court, which examined the two appeals on February 16, considered in its decision handed down on Wednesday that the “procedure is regular and the sentences have been legally applied” by the Assize Court for Minors in Paris.

According to the Court's judgment, "when violence has been exercised deliberately and simultaneously, with homicidal intent, by several defendants, during a single scene, the offense can be assessed as a whole, without it is necessary to specify the nature of the violence exerted by each of the defendants on each of the victims”.

In addition, the Assize Court "characterised the main incriminating elements, resulting from the debates, which convinced it of the guilt" of one of the young men who had appealed to the Court of Cassation, specifies the decision, ensuring that the jury of the court was "legally composed".

Contacted by AFP, the lawyers for the two young people, now 23 years old and still in detention, did not react immediately.

In parallel with this last resort, the defense attacked the way in which the investigation had been carried out in 2016 by the police officers of the departmental security of Essonne.

In July, a judicial investigation against X for “forgery in public writing”, “fraud in judgment” and “willful violence”, all by “person depositary of public authority”, was opened in Créteil, after several complaints.

Since then, an expertise has been underway: it aims to transcribe and analyze the recordings of police custody in order to reveal the precise conditions.
