The Frankfurt Regional Court has sentenced a 51-year-old police officer to a fine of 90 daily rates of 80 euros each for assault in office.

The officer had appealed a conviction by the district court, which sentenced him to six months' probation in October last year.

He admitted the allegations in full, but told the district court that he felt completely misrepresented by the judgment of the first instance: "I never, ever have a sadistic inclination.

It was just about speeding things up.”

The “measure” involved the following: A 55-year-old man who had previously been arrested had stubbornly resisted having blood drawn during the night in central police custody.

According to a wording from the files, he behaved “childishly” and insulted the officials.

Although he was tied to a chair surrounded by five officers, the accused policeman grabbed his nostrils.

The man later left police custody bleeding profusely.

"It's obvious that someone shouldn't walk away from police treatment like that," said the presiding judge.

"I had death in mind as I was abused and beaten from two sides," the man said as a witness in court.

He was found to have an alcohol level of 2.57 per mille at the time.

He has since been convicted of drunk driving and hit-and-run accident that night.

Although it was not possible to calm the man down, the policeman regrets his action: "The grip on the nose was unprofessional.

I just wanted to prevent him from getting up and fighting back." According to the public prosecutor's office, however, he "overshot the mark significantly".

Nevertheless, the presiding judge followed the decision of the authority, which assumed that the case of bodily harm was less serious.

The extent of the immediate compulsion had indeed been exceeded, she said.

However, it is not a direct, but only a conditional intention to recognize.

After lengthy consultation with the jury, she came to the conclusion that a fine should be imposed instead of a suspended sentence.

The defendant also has to pay part of the costs of the appeal proceedings.

For the chamber it was "crystal clear that this is enough to react appropriately to this story".

The accused immediately waived the right to appeal against the verdict.

However, the case is not over for him.

He will next face a disciplinary proceeding within the police force.
