June 29, 2021 The judicial process that must lead to ascertaining the truth about the Mottarone cable car disaster, which cost the lives of 14 people on 23 May last, is complicated. The decision of the president of the Court of Verbania Luigi Montefusco to replace judge Donatella Banci Buonamici with judge Elena Ceriotti in the investigation into the Mottarone massacre was not correct. But neither was the initial self-assignment of the dossier correct, as Banci Buonamici could not perform as investigating judge.



According to what transpires from environments of the Palace of Justice, this is the opinion of the judicial council of Turin, which will now send its opinion to the CSM so that it can evaluate which disciplinary measures to take.



 The territorial body of self-government of the Piedmontese magistrates, led by the president of the Court of Appeal Edoardo Barelli Innocenti, heard Montefusco and Banci Buonamici seven days ago. According to what emerged, therefore, both would not have respected the rules for the allocation of files. Neither Banci Buonamici, who had self-assigned the file, nor Montefusco, who replaced the investigating judge after the latter had ordered the release of the three suspects.



At that point the file had been reassigned to the investigating judge Elena Ceriotti, but according to the Judicial Council it was assigned to Annalisa Palomba, who from the beginning should have dealt with the file on the collapse of the cable car cabin in which fourteen people died on 23 May.
