The selectivity tests in Catalonia, which must be held on June 8, 9, 10 and 11, are under judicial scrutiny. The Assembly for a Bilingual School of Catalonia (AEB) has filed a lawsuit before the Contentious-Administrative Chamber of the Superior Court of Justice of Catalonia (TSJC) against the instructions of the Interuniversity Council of Catalonia, which depends on the Department of Research and Universities of the Generalitat regarding this test to which 40,000 Catalan students are summoned.

Specifically, the Consell Interuniversitari de Catalunya has drawn up, as every year, a series of rules for the members of the selectivity courts, although there is one that has revolted the association for the rights of bilingualism: The one that urges to distribute the exercises in Catalan and only in the event that a student requests it, will they be able to deliver a copy of the exam in Spanish. "First hand out the exam statements in Catalan and, only if a student asks for it, give them the Spanish version and retrieve the Catalan version. For statistical purposes, it is necessary to state in a report how many are delivered, in Spanish, without identifying the students ", highlights the regulation appealed by the AEB.

The entity considers that these instructions violate constitutional rights such as non-discrimination and education and they request the TSJC to adopt very precautionary measures due to the special urgency for the Interuniversitari Council of Catalonia to order the members of the courts of the selectivity that they distribute to the students the statements of the exam in Catalan or Spanish or Aranese according to the student's choice.

The TSJC is studying this measure taking into account that the selectivity tests begin next Tuesday. The AEB considers that the priority distribution of exams in Catalan is contrary to the principle of non-discrimination and the right to education, since these tests are decisive for the academic future of students and must therefore be carried out under equal conditions, without that no type of discrimination can influence its result.

In addition, they recall that national regulations recognize that students have the right to choose the official language in which they want to take the tests, so the instructions given to the selectivity courts are contrary to the Constitution. In the lawsuit, they point out that there is a judgment of the TSJC from a few years ago that annulled the sanction imposed on a professor at the Rovira i Virgili University of Tarragona who had asked the students about the language in which they wanted to take the exam, while at the same time He delivered the exercise in the language of his choice, whether it was Catalan or Spanish. In case law there is also an order of April 21, 2021 of the Contentious-Administrative Chamber of the Superior Court of Justice of Catalonia that forced, on the occasion of the sixth grade assessment tests,to the Department of Education to distribute the exams in Spanish or Catalan in schools, depending on the language of the student's choice.

That is why the entity considers that "the misinformation about the possibility of choosing the exam in either of the two languages, the necessary express request and the accounting of the number of exams delivered in Spanish, are intended to hinder the student from choosing this language to answer It is a clear discrimination on grounds of language that the Interuniversity Council of Catalonia establishes, only for identity reasons, a preponderance of Catalan over Spanish, which clearly harms students who want to carry out the exercises in Spanish or Aranese ".

Other actions

Several entities, grouped in the Constitutional Civic Table, have started a campaign to inform high school students, parents, family associations, educational centers and teachers, who reside in bilingual autonomous communities, of the right that assists them to be handed over, to the start of each selectivity test, the exams in the two official languages ​​of each autonomy. They consider that the test courts must provide booklets in each of the two official languages ​​so that each student chooses the one that provides them with greater security and ease to carry out their exam ".
