Wiesbaden (dpa / lhe) - The general decree of the Limburg-Weilburg district, which also contains the 15-kilometer regulation to contain the corona pandemic, is partly illegal.

The Wiesbaden Administrative Court decided in an urgent procedure.

The information contained on the 15-kilometer rule is lacking in "sufficient certainty", said the court on Tuesday.

However, the content must be “so complete, clear and unambiguously recognizable” for those affected that they can adjust their behavior accordingly.

In the order that came into force on January 11th, it says: "The radius of movement for day tourist excursions is limited to a radius of 15 kilometers from the place of residence (political municipality)."

The court found that the term “political community” was questionable because it “should not be understandable for a large part of the population”.

It is not clear whether the boundary of a district or the entire municipality is meant and how the 15 kilometers from the place of residence are actually to be measured.

The 15-kilometer rule affects corona hotspots with more than 200 new infections per 100,000 inhabitants in the past seven days and relates to leisure activities and day trips.

The judges also criticized the fact that the term “day tourist excursion” was not explained in more detail in the general decree.

They also had general doubts, "whether the restriction of the range of motion for day-trip trips could seriously contribute to reducing the number of infections in the Limburg-Weilburg district," the court said.

Instead, the measure should lead to many people then meeting other people inside.

The judges, on the other hand, considered the nocturnal exit restriction in the district, which also regulates the order, to be legitimate.

According to a court spokeswoman, the urgent proceedings had been initiated by a private person.

The decision, which was passed on January 15, initially only refers to the specific procedure, she explained.

The decision is not yet final, the appeal to the Administrative Court in Kassel is permissible.
